The aim is to ensure the proper and smooth operation of contract administration. (Scope of Application) Article 2: Contract administration procedures of the Institution shall be handled in accordance with these regulations, in addition to laws and regulations and other prescribed rules. (Scope of Contracts that Budget Responsible Officers Can Conclude) Article 3: The scope of contracts that budget responsible officers, as defined in Article 3, Paragraph 3 of the Nara National College of Technology Budget Regulations, can conclude is limited to the purchase of goods such as books and consumables where the contract amount is less than 1 million yen and the price per item is less than 500,000 yen, and service provision where the contract amount is less than 500,000 yen (excluding service provision handled by the Facilities Division). 2. Budget responsible officers shall comply with these regulations and other related regulations prescribed by the Institution. (Contract Execution) Article 4: Contracts shall be concluded by the President. However, the authority to conclude certain contracts may be delegated to other officers and employees (hereinafter referred to as "officers and employees"). 2. The officers and employees to whom delegation may be made and the scope of contracts shall be separately stipulated. (Establishment of Committees) Article 5: The following committees may be established as necessary to handle contract administration: (1) Specification Development Committee for developing specifications for procurement of large-scale equipment, etc. (2) Model Selection Committee for selecting models when necessary in procurement contracts for goods. The duties, composition, and other necessary matters of the committees prescribed in the preceding paragraph shall be separately stipulated. Chapter 2 Qualifications of Bidding Participants (Qualifications of Bidding Participants) Article 6: The qualifications of persons wishing to participate in competitive bidding as prescribed in Article 32, Paragraph 2 of the Accounting Regulations shall be applied mutatis mutandis to the unified qualifications of all ministries and agencies (Ministry of Education, Culture, Sports, Science and Technology Competitive Participation Qualifications, etc.). However, for construction contracts, the general competitive (designated competitive) participation qualifications for construction work and the general competitive (designated competitive) participation qualifications for design and consulting services of the Ministry of Education, Culture, Sports, Science and Technology shall be applied mutatis mutandis. 2. When conducting general competitive bidding based on the qualification grades of general bidding participants as prescribed in the preceding paragraph (grades based on contract type, range of estimated prices for participation, etc.), if it is recognized that the number of participants with qualifications in that grade is scarce, etc., construction companies with qualification grades one or two levels higher, or one level lower than the grade of qualifications may be included. 3. The provisions of the preceding two paragraphs shall be applied mutatis mutandis to the qualifications of participants in designated competitive bidding. (Persons Who Cannot Participate in Competitive Bidding) Article 7: When conducting general competitive bidding as prescribed in Article 37, Paragraph 1 of the Accounting Regulations for sales, leases, contracts, etc., the following persons cannot participate in competitive bidding: (1) Minors, persons under guardianship, persons under assistance, and persons under adult guardianship (excluding those who have obtained consent necessary for contract conclusion). (2) Bankrupt persons who have not had their rights restored. (Persons Who May Be Prevented from Participating in Competitive Bidding) Article 8: If a person is found to fall under any of the following items, they may be prevented from participating in competitive bidding for a period not exceeding two years. The same shall apply to persons who use such a person as an agent, manager, or other employee. (1) When the person has intentionally performed work or manufacturing crudely in the performance of a contract, or has committed fraudulent acts regarding the quality or quantity of goods. (2) When the person has obstructed the fair execution of competition, or has colluded to harm fair prices or gain unjust profits. (3) When the person has obstructed the conclusion of a contract by a successful bidder or the performance of a contract by a contractor. (4) When the person has obstructed the execution of duties by an employee during supervision or inspection. (5) When the person has failed to perform a contract without justifiable reason. (6) When the person has used, as an agent, manager, or other employee, a person who is prevented from participating in competitive bidding under the provisions of the preceding paragraph (excluding item (5)) in the conclusion or performance of a contract. 2. Persons who use a person falling under the provisions of the preceding paragraph as their bidding agent may be prevented from participating in competitive bidding. Chapter 3 Public Notice, etc., and Competitive Bidding (Public Notice of Bidding) Article 9: When intending to conduct general competitive bidding as prescribed in Article 37, Paragraph 1 of the Accounting Regulations by means of bidding, public notice must be given by posting or other means at least 10 days prior to the bidding date. However, if urgent, the period may be shortened to 5 days. (Matters to be Announced in Public Notice of Bidding) Article 10: The public notice as prescribed in the preceding Article shall be for the following matters: (1) Matters for competitive bidding (2) Matters concerning the qualifications required for competitive bidding participants (3) Location where contract terms are shown (4) Location and date of competitive bidding execution (5) Matters concerning bid bonds and contract deposits (6) Other matters deemed necessary. 2. It must be clarified in the public notice that bids submitted by persons who do not possess the qualifications required for competitive bidding as prescribed in item (2) of the preceding paragraph, and bids that violate the conditions related to bidding, shall be invalid. (Notification of Designation for Designated Competitive Bidding) Article 11: When conducting designated competitive bidding, the matters listed in Article 10, Paragraph 1, items (1) and (3) to (6) shall be notified in writing to the designated person. 2. The provisions of Article 10, Paragraph 2 shall apply mutatis mutandis to the notification of designation in the preceding paragraph. (Bid Bond) Article 12: When intending to conduct competitive bidding, each person wishing to participate in the competition shall deposit a bond of not less than 5/100 of their estimated contract amount. 2. The deposit of the bond in the preceding paragraph shall be made by transferring funds to a financial institution designated by the Institution by a date separately determined. (Exemption of Bid Bond) Article 13: In the following cases, the entire or a part of the bid bond may be exempted regardless of the provisions of the preceding Article. (1) When the person wishing to participate in the competition has concluded a bid bond insurance contract with an insurance company, etc., with the Institution as the insured. (2) When it is recognized that there is no risk of the qualified person as prescribed in Article 6 failing to conclude a contract. (Bid Explanation Meeting) Article 14: If it is deemed necessary to provide supplementary explanations for matters that are difficult to describe in writing, such as the content of the contract, bidding conditions, matters that may cause errors, etc., indicated in the public notice, designation notification (hereinafter referred to as "public notice, etc.") and bid explanation document, a bid explanation meeting may be held. (Preparation of Estimated Price) Article 15: When intending to conduct competitive bidding, an estimated price must be prepared in writing (hereinafter referred to as "estimated price document") based on the specifications, design documents, etc., of the matter for which a contract is to be concluded. 2. The estimated price document shall be sealed and placed at the bid opening location at the time of bid opening. (Method of Determining Estimated Price) Article 16: The estimated price shall be determined for the total price of the matters to be put to competitive bidding. However, for contracts involving manufacturing, repair, processing, sales, supply, use, etc., that continue for a certain period, the estimated price may be determined by unit price. 2. The estimated price shall be determined appropriately by considering the actual transaction prices, demand conditions, difficulty of performance, quantity, length of performance period, etc., for the goods or services that are the object of the contract. (Execution of Bidding) Article 17: When executing competitive bidding, a bid form containing the following matters must be submitted by the competitive bidding participant or their agent (hereinafter referred to as "competitive bidding participant, etc."). (Prohibition of Exchange, etc., of Bid Forms) Article 18: When executing bidding, competitive bidding participants, etc., shall not be allowed to exchange, change, or withdraw their submitted bid forms. (Correction of Bid Forms) Article 19: In advance, the bid explanation document, etc., must inform competitive bidding participants, etc., that if they correct matters written on the bid form, the corrected part must be sealed by the competitive bidding participant, etc. (Bidding by Agent) Article 20: When an agent bids, a power of attorney must be submitted from the competitive bidding participant, etc., in advance. (Bid Opening) Article 21: Bids shall be opened in the presence of competitive bidding participants at the location and date of competitive bidding execution indicated in the public notice, etc. In this case, if competitive bidding participants are not present, employees unrelated to the bidding procedures shall be present. (Restriction on Entry and Exit from Bidding Room) Article 22: Persons other than competitive bidding participants, etc., employees related to bidding execution (hereinafter referred to as "bidding related employees"), and the observers prescribed in the preceding Article shall not enter the bidding room. 2. After the bidding begins, competitive bidding participants, etc., shall not be allowed to enter the bidding room. 3. Unless there are particularly unavoidable circumstances, persons who have entered shall not be allowed to leave.
