(5) Confirmation of Bid Participation Qualifications Applicants for this project must submit the Application Form and Documents to prove they possess the competitive bidding qualifications listed in 2 and undergo confirmation of their qualifications by the Authorized Signatory for Expenditure Control. Those who do not meet the requirements listed in 2.(3) can also submit the Application Form and Documents, but if they meet the requirements listed in 2.(1), (2), and (4) to (9), their competitive bidding qualification will be confirmed on the bid opening date, subject to meeting the requirements listed in 2.(3). However, those who have received such confirmation must meet the requirements listed in 2.(3) on the bid opening date to participate in the bidding. (6) Invalid Bids Bids submitted by those who do not possess the qualifications listed in 2, bids with false statements in the Application Form or Documents, and bids that violate the conditions of bidding specified in the Bidding Instructions (including attached specifications, etc.) and the "Civil Aviation Bureau Competitive Contract Bidding Rules" shall be deemed invalid. If the successful bidder is one who submitted an invalid bid, the award of the contract will be revoked. Furthermore, even if a person has been confirmed as qualified by the Authorized Signatory for Expenditure Control, if they do not possess the qualifications listed in 2 at the time of bid opening, they will be considered unqualified. (7) Bidding Method Bidders shall state in their bid the amount equivalent to 100/110 of the contract amount, including all related expenses, regardless of whether they are subject to consumption tax and local consumption tax. When determining the successful bidder, the amount stated in the bid will be increased by 10% of that amount (rounded down to the nearest yen) to determine the contract price. In principle, the number of bid executions will be limited to two. If a successful bidder is not determined within this number of bids, the procedure will not, in principle, transition to a discretionary contract based on the provisions of Article 99-2 of the Budgetary Order. (8) Method of Determining Successful Bidder The successful bidder will be the one with the highest evaluation value within the limit of the estimated price, based on Article 79 of the Budgetary Order. However, if it is recognized that the intended successful bidder may not be able to perform the contract in accordance with its terms due to their bid price, or if it is recognized that concluding a contract with them would be significantly inappropriate due to the risk of disrupting fair trade order, another bidder who has submitted a bid within the limit of the estimated price and has the highest evaluation value may be selected as the successful bidder. If the bidding results in a bid below the Survey Standard Price, it will be declared "On Hold," and the successful bidder will be determined at a later date, stating that the contract award will be made based on the proviso to Article 29-6, Paragraph 1 of the Public Accounting Act. After the bidding ends, the surveyed bidder will immediately cooperate with the Low Bid Price Investigation by conducting interviews and inquiries with relevant parties. During the investigation period, the bidder is the "lowest bidder" but not the "successful bidder," so they are not guaranteed to be the successful bidder.
