The client will carry out a phased commissioning, whereby stage 1 with performance phases 1 to 4 will be commissioned first. See tender documents for details. I. Declarations of intent The following declarations of intent, which you will find in the tender documents, must be completed and signed with the offer: 1) VHB Bund 124 "Declaration of intent regarding suitability" 2) VHB NRW 521 "Declaration of intent Exclusion grounds" 3) VHB NRW 522 "Declaration of intent Minimum Wage Act" 4) VHB NRW 523 EU Declaration of intent Sanctions package (Russia) III. Review clause In accordance with Section 132 (2) No. 1 in conjunction with Section 132 (2) No. 4a GWB or in accordance with Section 132 (2) No. 1 GWB, the City of Schwelm reserves the right to offer the execution of services to suitable bidders who have submitted an economically acceptable offer in the award procedure, if the contractor finally fails due to termination or for another reason. In the event that the award winner finally fails before complete performance of services due to termination, insolvency or for another reason, the client reserves the right to offer the remaining work to the other bidders in the order of the award result up to 5th place. The additional costs incurred as a result are to be borne by the previous contractor under the aspect of substitute performance. This applies only if the resulting increase in the total price remains within the framework provided by Section 132 (3) GWB. IV. Defence clause These Additional Contractual Terms and Conditions apply exclusively. The City of Schwelm only recognises conflicting or deviating terms and conditions of the contractor if the City of Schwelm expressly agrees to their validity in writing. These Additional Contractual Terms and Conditions shall also apply if the City of Schwelm accepts or pays for the delivery without reservation, knowing of conflicting or deviating terms and conditions of the contractor. V. Commitment Act (VerpflG, date of issue: 02.03.1974) The Commitment Act applies to this tender. Accordingly, contractual partners of the public sector are obliged to conscientiously fulfil their obligations. VI. Performance period: after award until approximately 06/2029 VII.
