Mecanismo de resolución de empates:
En el evento de que una vez culminado el proceso de evaluación de ofertas, hubiese dos o más proponentes que hayan obtenido el mismo puntaje máximo, quedando más de uno en condiciones de resultar adjudicados, se optará por aquella oferta que cuente con un mayor puntaje en el criterio precio. En caso de mantener el empate, se seleccionará a la oferta que presente un mayor puntaje en el criterio Calidad Técnica. De persistir el empate se seleccionará a la oferta que presente un mayor puntaje en el criterio comportamiento contractual y finalmente si persiste el empate al proveedor que tenga un mayor puntaje en el criterio Programa de Integridad y así sucesivamente. Finalmente, si aún persiste el empate, se seleccionará a la propuesta que ingresó primero en www.mercadopublico.cl.
A.MECANISMO PARA SOLUCIÓN DE CONSULTAS RESPECTO A LA ADJUDICACIÓN
Los oferentes tendrán un plazo de tres días hábiles desde la notificación de la adjudicación a través del portal Mercado Público, para hacer consultas sobre la adjudicación a través del sistema de información, mecanismo implementado por el Portal Mercado Público.
A.PRESENTACIÓN DE ANTECEDENTES OMITIDOS POR LOS OFERENTES
Una vez realizada la apertura electrónica de las ofertas, la Brigada Motorizada N.° 24 “Huamachuco”, podrá solicitar a los oferentes que salven errores u omisiones formales, siempre y cuando las rectificaciones de dichos vicios u omisiones no les confieran a esos oferentes una situación de privilegio respecto de los demás competidores, conforme al artículo 56 del reglamento de la Ley N.° 19.886 estos serán evaluados con el criterio de requisitos formales y se les asignara un menor puntaje a los oferentes que presenten dichos documentos en una segunda instancia esto en tanto no se afecten los principios de estricta sujeción a las bases y de igualdad de los oferentes, y se informe de dicha solicitud al resto de los oferentes si correspondiere a través del Sistema de Información.
Se permitirá, asimismo, la presentación de certificaciones o antecedentes que los oferentes hayan omitido presentar al momento de efectuar la oferta, siempre que dichos documentos, certificaciones o antecedentes se hayan producido u obtenido con anterioridad al vencimiento del plazo para presentar ofertas o se refieran a situaciones NO mutables entre el vencimiento del plazo para presentar ofertas y el periodo de evaluación. Los oferentes tendrán un plazo máximo de 24 horas, contados desde la notificación de adjudicación del respectivo requerimiento, para responder a lo solicitado por la Entidad licitante o para acompañar los antecedentes requeridos por ésta.
