Supply of All in One computers (Type 1), All in One computers (Type 2) within the project "MaraHUB – Funding libraries in Maramureș county to become digital skills development hubs"

The contracting authority wishes to procure IT equipment: All in One Computers (Type 1), All in One Computers (Type 2). Through the acquisition of products related to this product, the contracting authority wishes to replace/modernize IT equipment in 1030 libraries, as well as develop basic skills such as digital literacy, communication, media literacy, digital content creation, digital security, and digital entrepreneurship for 100,000 citizens from disadvantaged communities. Within the project, grants will be awarded based on a funding request for library space upgrades and expansions, computer/tablet and training equipment procurement, equipping maker spaces and object libraries, and community member training. Delivery term: maximum 45 days Clarification: Regarding co-financing from the local budget! The public procurement contract award procedure is initiated under the incidence of this suspensive clause, meaning that the conclusion of the public procurement contract is conditional upon the allocation of budgetary credits for this purpose, the signing of the contract being done in compliance with the provisions regarding the commitment of expenses from budgets falling under the scope of public finance legislation. Considering the provisions of Law no. 98/2016 on public procurement and Government Decision no. 395/2016, with subsequent amendments and additions, the contracting authority specifies that it will conclude the contract with the winning bidder only to the extent that the funds necessary for the procurement are ensured by allocating budgetary credits for this purpose. In the event that, regardless of the reasons, budgetary credits are not allocated, the contracting authority, after receiving notification regarding the non-granting of financing, reserves the right to cancel the award procedure, provided that there is no other source of financing, in accordance with the provisions of art. 212 para. (1) letter C) the second part of Law 98/2016 with subsequent amendments and additions, it being impossible to conclude the public procurement contract. Bidders in this procedure understand that the contracting authority cannot be held liable for any damage in case of cancellation of the award procedure, regardless of its nature and whether the contracting authority has been notified of the existence of such damage. Bidders in this procedure accept the use of the special conditions above/suspensive clause, assuming full responsibility for any damages they may suffer in the described situation.
