Original language: fiVarsinais-Suomen hyvinvointialueen Tyks sairaalapalveluiden tarpeeseen hankitaan julkisista hankinnoista ja käyttöoikeussopimuksista annetun lain (1397/2016, ”hankintalaki”) 26 §:n EU-kynnysarvon ylittävänä suorahankintana GE PET-TT laitteen huoltopalvelua GE Healthcare Finland Oy:ltä. Huoltosopimus voidaan ottaa vain laitetoimittaja GE Healthcare Finland Oy:lta. GE Healthcare Oy:n huoltopalvelu takaa laitevaatimuksille perustuvat lakisääteiset (Laki lääkinnällisestä laitteesta 719/2021) määräaikaishuollot, jotka ovat välttämättömiä laitteen toimintakyvyn ylläpitämiseksi. Kyseinen laite on välttämätön osaston toiminnalle. Laitevalmistajan hyväksymä tai kouluttama henkilö suorittaa sopimuksen mukaiset valmistajan määrittämät laitteen huoltotoimenpiteet, sekä vikakorjaukset mukaan lukien määräaikaishuollot ja niihin tarvittavat osat. Suorahankinnan perusteena on hankintalain 40 §:n 2 momentin 2 kohta teknisestä syystä vain tietty toimittaja voi toteuttaa hankinnan; lisäedellytyksenä on, että järkeviä vaihtoehtoisia tai korvaavia ratkaisuja ei ole eikä kilpailun puuttuminen johdu hankinnan ehtojenkeinotekoisesta kaventamisesta.
