The winning tenderer must submit their offer with knowledge of this condition. Performance will be based on individual orders as stipulated in the draft contract. A price list must be submitted as a professional commercial offer. Tendering for all items in the table is mandatory. The framework agreement is valid for 12 months from the date of entry into force (or for the extended period in case of extension) or until the framework amount of HUF 30,000,000 net is exhausted. The performance deadline for individual orders placed under the Contract will be determined by the Parties in the individual orders, but the performance deadline may not be shorter than 24 hours from the receipt of the order – the confirmation of the order by the Seller in the EKR, i.e. in a given case, the delivery obligation may also fall on a public holiday, taking into account the Buyer's obligation to perform its tasks: i.e., continuous availability must be ensured, taking into account § 104 (3) of the Public Procurement Act. The exact name and technical parameters of the Products to be delivered are included in the technical specification, which is part of the Procurement Documents. The designation in the technical specification and the table forming part of it serves to clearly define the Product; in addition to the specified brand, origin, or type designation in the call for tenders or in the Procurement Documents, the phrase "or equivalent" must always be added. The specified requirements and conditions are the minimum requirements of the contracting authority; offers for products with more favorable characteristics than these can also be submitted to the contracting authority, thus products with characteristics equal to or more favorable than the specified minimum conditions may meet the technical and commercial requirements, with the proviso that a more favorable offer will not be evaluated separately; the contracting authority will apply the lowest price evaluation criterion, with the sum obtained by multiplying the unit price of the items in the table by the weighting factor determined for each item being the price to be indicated on the reading sheet ("NET OFFER PRICE TO BE INDICATED ON THE READING SHEET").
