The Contracting Authority reserves the right to deviate from the specified quantities by exceeding the available framework amount by a maximum of 20% during the contract period. The Contracting Authority intends to conclude contracts with a validity of 3 (three) months during the existence of the DPS, but reserves the right to conclude contracts with a longer validity. The Contracting Authority shall provide the precise technical description and contractual conditions for the specific public procurements to be carried out within the system pursuant to Section 107 (2) of the Public Procurement Act simultaneously with the dispatch of the invitation(s) to tender. The expected maximum order of magnitude for individual contracts is: 4538 kg. The Contracting Authority draws attention to the provisions of Section 46 (3) of Government Decree 321/2015 (X. 30.) that references to a thing of a specified make or origin, or a specific procedure characterizing the products or services provided by a particular economic operator, or to a trademark, patent, activity, person, type, or specific origin or manufacturing process in the procurement document serve to define the subject of the procurement clearly, precisely and understandably. In all cases, the phrase "or equivalent" must be understood alongside the reference. The tenderer must prove equivalence in the tender in accordance with Chapter VII of Government Decree 321/2015 (X. 30.). The tenderer may only submit offers for products that fully comply with the requirements of the Contracting Authority, are of Class I, and meet the requirements specified in the Hungarian Food Codex. In relation to the products, the tenderer must also take into account the information provided in the procurement documents.
