Installation of renewable energy sources for residents of the Zagórów Commune.

The subject of the order is the design, supply, installation and commissioning of: a) 137 photovoltaic installations, b) 127 electricity storage installations, c) 81 air source heat pump installations for central heating and domestic hot water, d) 24 ground source heat pump installations for central heating and domestic hot water, e) 210 thermal energy storage units associated with heat pumps. hereinafter collectively referred to as "Installations". The supply, installation and commissioning of the Installations are intended for the production and storage of energy from renewable sources for facilities located on properties within the Zagórów Commune, indicated in Annex 1a to the SWZ, updating the table informing about the Project participants, presented on pages 2-18 of the Functional-Utility Program (hereinafter referred to as "PFU"), which is Annex No. 1 to the SWZ. Due to the resignation of some Project participants, the Ordering Party has presented updated information on the installations to be carried out within the Project for Users in Annex 1a. 2) The Ordering Party indicates that based on the agreements concluded with the Users, it has obtained their consent to carry out activities related to the design, supply, installation and commissioning of installations necessary for the implementation of the Project's objectives. 3) Option right: The Ordering Party reserves the right to extend the scope of the Order to include additional supplies covering the Ordering Party's additional, current needs (hereinafter: "Option right") on the following terms: increasing the scope of the subject of the order by increasing the number of Installations referred to in point 1, to be supplied, installed and commissioned by the Contractor. The option right will be exercised taking into account the following principles: a) The Ordering Party will decide on the use of the Option right within 14 days from the date of conclusion of the Agreement with the Contractor – based on the assessment of applications from potential Users other than those indicated in the list specified in Annex No. 1a to the SWZ. b) The maximum value of the option will not exceed 15% of the order value resulting from the offer submitted by the Contractor. c) The remuneration due to the Contractor under the Option right will be determined based on the estimated value of the supply, installation and commissioning of Installations: photovoltaic, electricity storage, air source heat pumps for central heating and domestic hot water, and ground source heat pumps for central heating and domestic hot water, indicated by the Contractor in the Offer form. d) The Option right is the Ordering Party's entitlement, which it may or may not exercise within the framework of the Agreement. Within the framework of the Option right, the Ordering Party reserves the right to fully or partially commission the execution of the subject of the order covered by the option right. e) In the event that the Ordering Party does not exercise the Option right in whole or in part, the Contractor is not entitled to any claims in this regard. f) The condition for exercising the Option right is the submission by the Ordering Party of a declaration of intent in writing or electronic form (within the meaning of Art. 78(1) of the Civil Code) regarding the exercise of the Option right. g) The principles of exercising the Option right are specified in the draft Agreement (Annex No. 2 SWZ). 12). The scope of the subject of the order includes: a) development of complete design documentation necessary for the supply, installation and commissioning of the installations specified in point 1. b) obtaining the necessary approvals, permits, notifications required by applicable law to perform the subject of the order and achieve its goal; c) installation, according to the developed design documentation, of the Installations specified in point 1, corresponding to the conditions specified in the PFU, including in particular the execution of installation and construction works described in point 6 of the PFU ("Description of the Ordering Party's requirements for the subject of the order"); d) Execution of inspections, tests, measurements, technical start-up and commissioning of the Installations, in accordance with applicable law and standards...
