(Interim) catering services ANKER-Dependance Musenbergstraße, Munich

The public contract - the so-called interim award - or its necessity is based, in a way, on the open procedure 'Catering services in the ANKER-Dependance Musenbergstraße, Munich', ref.: 0270.ZV-12-25-31, or publication number: 829767-2025, and the procedural difficulties unexpectedly associated with it (including various procedural objections, extended clarification needs) or the resulting time delays. The urgent need for continued provision of services - public welfare - is to be temporarily met through the specific negotiated procedure without a call for competition, i.e., until the successful completion of the aforementioned procurement procedure. The Free State of Bavaria, represented by the Government of Upper Bavaria – hereinafter referred to as the "Client" or "AG" – is responsible for operating the ANKER Oberbayern. The AG is issuing a tender for catering services in the ANKER-Dependance Musenbergstraße, Munich – hereinafter referred to as the "Dependance". In the Dependance, asylum seekers are accommodated and provided for, typically for up to 24 months. The AG commissions the contractor – hereinafter referred to as the "Contractor" or "AN" – with catering in the form of full meal and beverage provision as well as the delivery of packed lunches upon individual request. During the contract period, individual services included in the scope of services may be discontinued or later re-added. The Dependance is a socially sensitive property. Particular account must be taken of the special sensitivity of the protective mandate, the increased public visibility, and the specific conditions in dealing with foreign refugees (e.g., language barriers, trauma, and different mentalities and cultures). The Contractor and its employees must treat asylum seekers with respect and, where necessary, coordinate and liaze with other site-specific service providers.
