The bidder declares that, by the mere act of participating in this tender, they expressly accept this integrity pact, committing to comply with each and every one of its stipulations, without prejudice to those indicated in the rest of the bidding documents and other integral documents. Specifically, the bidder agrees to provide all information and documentation that is considered necessary and required in accordance with these bidding documents, expressly assuming the following commitments: For the purposes established in these bidding documents, the Technical Counterpart will be the requester or whoever the Seremi designates for this function. The Seremi, in order to coordinate and supervise the correct fulfillment of the contract by the provider, will have the following powers: i. Through its Administration and Finance Department or the unit, division, section or department that continues its functions: a. It will keep the file with all the original contract documents updated; b. It will approve payments, after a conformity reception report of the goods and/or services by the Head of the requesting unit; c. In case of fines, it will calculate their amount and may enforce them by deducting their amount from the respective payments. d. It will supervise, prior to payment, compliance with labor regulations by requesting the certificate of compliance with social security and labor obligations of the provider, issued by the Directorate of Labor, along with the list of workers involved in the provision of the service. In the case of UTP, each of its members must accompany said certificate. e. In its case, it will determine the early termination of the contract, based on the non-compliance report and the background information provided by the requester, as well as the respective defenses filed by the provider. ii. Through the Requesting Section or the unit, division, section or department that continues its functions: a. It will issue the conformity reception report of the goods and/or services by the provider. This document will address the compliance with the contractual obligations assumed by the provider and will be a condition for payment approval by the Administration and Finance Department in accordance with letter c) of the preceding number; b. In case of breach of contract by the provider, it will inform and provide the background information to the Administration and Finance Department through a reasoned report of non-compliance of products and/or services; c.
