Construction of the New Port of Korčula – Polačište Port

The subject of this procurement is the works for the construction of the New Port of Korčula – Polačište Port on the island of Korčula which were not completed after the termination of the contract with the previously contracted contractor. The planned works include: maritime structures, land development and external infrastructure, works on the passenger terminal building and port terminal facilities. Course of events: The Contracting Authority issued an open public procurement procedure for the procurement of works for the construction of the new port of Korčula on 18.2.2021: publication number from EOJN: 022/S 0F3-0033594 and 2022/S 164-463221 in TED. The contract with the selected contractor, the consortium of bidders Aqua Mont Service d.o.o., Obrenovački drum 27a, 11030 Belgrade, Serbia, OIB: PIB105238979 and Aqua Mont Service d.o.o. for services, Gundulićeva 22, 21000 Split, Croatia, OIB:98862970595 was signed on 11.05.2022. The termination agreement entered into force on 12.3.2025. The contracted consortium of bidders performed part of the contracted works, for which records were kept in accordance with professional standards. By the termination of the contract, the consortium of bidders had completed approximately 43% of the works. After the termination of the Contract, the Contracting Authority commissioned a 3D survey of the underwater part of the completed state, which is available at: https://vectrino.nira.app/a/4M3anOhwSKSdCU66FNE3nA The Contracting Authority has prepared photographic documentation of the construction site and the existing condition, which forms an integral part of this Documentation. The Contracting Authority commissioned and published surveys of the completed state with the aim of ensuring the best possible insight into the actually completed works and reducing risks, so that bidders can estimate costs more realistically based on reliable and transparent data, especially considering the fact that the works are performed on a 'turnkey' basis. The designer has been commissioned to revise the bill of quantities and prepare new bills of quantities for the remaining unperformed works. A geodetic-hydrographic survey of the existing condition of the Polačište port construction site has also been prepared, no.pr. 189/2025, Terestrika d.o.o. dated 10.7.2025. The subject of the procurement will be realized according to the standardized contract form "Conditions of Contract for Construction" (RED BOOK) first edition 1999 published by "Federation Internationale des Ingenieurs-Conseils" (FIDIC) (International Federation of Consulting Engineers) and with the "Turnkey" clause. The "Turnkey" clause implies a total contract price, i.e., it includes all necessary works that are the subject of this procurement for the execution and completion of the works according to the bill of quantities and project documentation in definitive form and correct function up to the complete functionality and use of the building, which includes all works and temporary solutions, regardless of the completeness of the description of items and technical solutions in the bill of quantities and in the project documentation and possible surpluses of works, unforeseen and subsequent works, and excludes the impact of shortages of works on the contract price, assuming that the scope of contracted works has not been changed based on the agreement of the contracting parties or for reasons for which the contracting authority is responsible (in accordance with Article 630 of the Law on Obligations NN 35/05, 41/08, 125/11, 78/15, 29/18, 126/21, 114/22, 156/22, 155/23). The General Conditions and Particular Conditions together form the Contract for the Execution of Works, which regulates the rights and obligations of the contracting parties.
