Opdrachtgever: Gemeente Den Helder
Als Strategisch juridisch adviseur fungeer jij als juridisch expert in de grotere juridische dossiers die in onze gemeente spelen. Dit doe jij op een kwalitatief hoogwaardig juridisch niveau waarbij jij oog hebt voor strategie en bestuurlijke belangen. Geen dag is hetzelfde: jij schakelt moeiteloos van stevige strategische juridische advisering naar het eigenhandig opstellen van juridische producten (zoals overeenkomsten, beschikkingen en processtukken). Ook vertegenwoordig jij de gemeente in en buiten rechte, zowel in formele juridische procedures als in minnelijke onderhandelingstrajecten. Waar nodig werk jij hierbij samen met onze huisadvocaten. Daarnaast heb jij oog voor de juridische kwaliteit in onze organisatie op langere termijn en werk jij actief aan het verbeteren hiervan.Concreet ga je je bezig houden met:- strategische juridische advisering- Complexe vraagstukken op staatssteun, inkoop en aanbestedingen- Afhandelen van schadeclaims, WOO en APVNa gunning dient de gegunde partij een VOG van de kandidaat te overleggen. Vanaf 1 januari wordt het handhavingsmoratorium op de wet DBA opgeheven. Dat betekent dat belastingdienst mogelijk kan gaan handhaven op schijnzelfstandigheid. Zelfstandigen die zich willen inschrijven op deze opdracht willen wij vragen om zich via een bureau te laten inschrijven op deze opdracht. Hierin staat de zelfstandige vrij in de keuze voor het bureau. Indien blijkt dit dat na gunning aan voorgaande niet wordt voldaan betekent dat de gunning automatisch komt te vervallen
