Gemeentegrond is waardevol en ook hard nodig bij de uitvoering van gemeentelijke taken en doelstellingen. Grond kan bijvoorbeeld nodig zijn voor het uitvoeren van beleidsdoelstellingen op het gebied van klimaatadaptatie, de uitvoering van de energietransitie of het versterken van de biodiversiteit. Het kom vaak voor dat er een stuk gemeentegrond bij een particuliere tuin is getrokken. Samen met de collega?s van team Gebruik Gemeentegrond sta jij aan de lat om het oneigenlijk gebruik van gemeentegrond op te lossen. Als juridisch medewerker gebruik gemeentegrond zorg jij voor een geheel zelfstandige dossierafhandeling aan de hand van de, door de gemeenteraad, vastgestelde kaders en uitgangspunten. Dit doe je binnen een klein en hecht team, waarbinnen veel ruimte is om te sparren. Je start een dossier altijd met het onderzoeken van verkoopmogelijkheden. Daarbij raadpleeg je verschillende specialisten binnen de gemeente voor advies over mogelijke verkoop. Vanzelfsprekend houd je daarbij ook rekening met de Didam-criteria. Blijkt uit het onderzoek dat verkoop mogelijk is en wil de inwoner de grond ook kopen? Dan ben je verantwoordelijk voor het gehele verkoopproces. Van publicatie van de voorgenomen verkoop, tot het opstellen van de koopovereenkomst en de overdracht bij de notaris. Is verkoop niet mogelijk of wil de inwoner de gemeentegrond niet kopen? Dan stuur je een brief waarin je verzoekt om de gemeentegrond terug te geven. Er kan ook sprake zijn van verjaring. Als inwoners een beroep doen op verjaring, toets jij de bewijsstukken aan de relevante wetgeving en jurisprudentie. Zijn inwoners niet bereid om de gemeentegrond vrijwillig terug te geven? Dan onderhoud je het contact met het cluster Veiligheid voor het opstarten van een procedure voor bestuursrechtelijke handhaving, of met de huisadvocaat voor het instellen van een ontruimingsvordering.
