Original language: GermanDie Kärntner Beteiligungsverwaltung (in der Folge auch „AG“ oder „Verpächterin“) beabsichtigte die langfristige Vergabe eines Pachtvertrages über dzt. unbebaute Liegenschaften in Steindorf am Ossiacher See. Ziel des gegenständlichen Verfahrens war sohin der Abschluss eines Pachtvertrags über die pachtvertragsgegenständlichen Liegenschaften zwischen der Verpächterin einerseits und der:dem im Verfahren bestgereihten Bieter:in andererseits (kurz „Pachtvertrag“). Die pachtvertragsgegenständlichen Liegenschaften befinden sich in der Katastralgemeinde Steindorf am Ossiacher See, Katastralgemeindenummer 72337 und bestehen aus den Grundstücken mit den Nummern 1140, 316/3 und 309/2. Die Grundstücke befinden sich im Eigentum der Verpächterin. Eine Badehütte, welche im Eigentum der Verpächterin steht und auf dem benachbarten, im Eigentum der Österreichischen Bundesforste (kurz „ÖBf“) befindlichen Grundstück liegt, war ebenso Gegenstand des abzuschließenden Pachtvertrages. Die Verpachtung der pachtvertragsgegenständlichen Liegenschaften sollte an eine:n Pächter:in erfolgen, welche:r auf den Liegenschaften ein attraktives touristisches Projekt – insbes. Betrieb eines touristischen Beherbergungsbetriebs – umsetzt und dieses ganzjährig betreibt (mind. 10 Betriebsmonate p.a.), wobei der Pächter neben der Gewährleistung eines öffentlichen Seezugangs und einer öffentlichen Gastronomie insbesondere auch ein Badehaus zu integrieren und zu betreiben hat. Näheres war in den Verfahrensunterlagen geregelt. Die Auftraggeberin bzw. Verpächterin hat im Zuge einer Fragenbeantwortung vom 23.04.2025 auch Vorgaben hinsichtlich der Namhaftmachung von dritten Unternehmen in der 2. Stufe des Vergabeverfahrens definiert.
