Zhotoviteľ stavby bude vybraný na základe výsledku verejnej súťaže s názvom: „Vybudovanie prepojenia ciest III/2415, III/2416 – Pršianska terasa“ vyhlásenej vo Vestníku verejného obstarávania č. 144/2024 dňa 25.07.2024 pod zn. oznámenia 18174-MSP a v Úradnom Vestníku EÚ OJ S 143/2024 zo dňa 24.07.2024 pod č. oznámenia 443426-2024. Trvanie výkonu stavebno – technického dozoru bude od prevzatia staveniska zhotoviteľom do kolaudácie stavby, resp. až do riadneho splnenia všetkých činností a povinností v zmysle prílohy č. 2 k SP Zmluva o výkone stavebného dozoru SP. Výsledkom verejného obstarávania bude uzavretie Zmluvy o výkone Stavebného dozoru medzi verejným obstarávateľom a úspešným záujemcom. Zmluva nadobúda platnosť dňom jej podpisu oprávnenými zástupcami zmluvných strán a účinnosť dňom nasledujúcim po dni zverejnenia zmluvy v Centrálnom registri zmlúv /www.crz.gov.sk/ a v súlade s § 47a ods. 1 zákona č. 40/1964 Zb. Občiansky zákonník v znení neskorších predpisov v spojení s § 5a zákona č. 211/2000 Z. z. o slobodnom prístupe k informáciám a o zmene a doplnení niektorých zákonov (zákon o slobode informácií) v znení neskorších predpisov nie však skôr ako nadobudne účinnosť Zmluva so zhotoviteľom stavby. Všetky náklady a ostatné práce priamo aj nepriamo súvisiace s poskytnutím služby musia byť súčasťou celkovej ceny. Navrhovaná zmluvná cena musí byť špecifikovaná ako maximálna a pevne daná. Cena sa nesmie meniť počas doby trvania zmluvného vzťahu. Akékoľvek iné zmeny sa môžu robiť len na základe písomnej dohody oboch zmluvných strán. Verejný obstarávateľ si vyhradzuje právo neprijať ponuku, ktorá prekročí výšku finančných prostriedkov, ktoré má na daný účel vyčlenené. Minimálne požiadavky na predmet zákazky stanovené verejným obstarávateľom ako aj podrobné vymedzenie predmetu zákazky sú uvedené v jednotlivých prílohách súťažných podkladov.
