2. The procedure is conducted in the form of an open tender in accordance with art. 132 of the Act of September 11, 2019, Public Procurement Law, hereinafter referred to as the "Act". Matters not regulated by the provisions of this SWZ shall be governed by the provisions of the aforementioned Act. 3. The procedure is conducted in Polish. 4. The contracting authority does not allow for the submission of variant offers. 5. The contracting authority does not foresee the awarding of contracts referred to in art. 214 sec. 1 item 7 of the Act. 6. This procedure is not conducted for the purpose of concluding a framework agreement. 7. The contracting authority does not foresee an electronic auction in this procedure. 8. The contracting authority does not require or allow the submission of offers in the form of electronic catalogs or the attachment of electronic catalogs to the offer. 9. The contracting authority does not reserve the right to award the contract only to contractors referred to in art. 94 of the Act. 10. The costs of participation in the procedure, and in particular the costs of preparing the offer, are covered by the Contractor. The contracting authority does not foresee reimbursement of participation costs in the procedure (except for the situation referred to in art. 261 of the Act). 11. The contracting authority will settle accounts with the Contractor exclusively in Polish currency (PLN). 12. The contracting authority does not require the submission of the subject evidence. 13. In accordance with art. 139 sec. 1 of the Act, the contracting authority will first examine and evaluate the offers, and then will qualify the contractor whose offer has been evaluated highest, in terms of the absence of exclusion grounds and fulfillment of the conditions for participation in the procedure.
