Construction investment Design and Construction The subject of this public procurement procedure is: A works contract (design and construction) for the "Design and construction of the House of Public Corporations (Building 7)" in AK Budapest, District 7, on the property registered under cadastral number 33505 in the interior of Budapest, at Városligeti fasor 9-13, with the designation "former museum, courtyard" and an area of 17,050 m2 (Property), in the so-called Building 7 (Property), through a construction investment (Reconstruction) involving the renovation and transformation (requiring a building permit) of the House of Public Corporations (House of Public Corporations), which will house the professional organizations of the Hungarian Chamber of Architects, the Budapest Chamber of Architects, the Hungarian Engineering Chamber, and the Budapest and Pest County Engineering Chamber on separate building levels. In accordance with Section 14 (1) b) and Section 14 (4) a) of Government Decree 322/2015 (X. 30.), the Reconstruction includes the preparation of the permit and construction design documentation and the execution of construction tasks in accordance with it (taking into account that the Contracting Authority does not have an approved permit design for the House of Public Corporations). Further investment on the Property (Architectural Museum Investment), as a parallel investment, and the existing design documentation of the House of Public Corporations were prepared by the designers who submitted the winning bid (1st place) in the design competition procedure with EKR identification number EKR000685692023 (Design Competition Procedure), Bivak Studio Kft. and Tér és Forma Szeged Építéstervező Kft. as joint tenderers, based on the design contract concluded as a result of the non-public negotiated procurement procedure according to Section 98 (5) of the Public Procurement Act (Kbt.) with EKR identification number EKR002285742023 (Preceding Non-Public Negotiated Procedure). AK has an approval plan for the Reconstruction according to Section 14 (6) of Government Decree 322/2015 (X. 30.). Pursuant to Section 1 (1) of Government Decree 319/2015 (X. 30.), Section 1 (1) of Government Decree 131/2016 (VI. 7.), and Section 1 (1) of Government Decree 257/2020 (VI. 3.), the subject of this Public Procurement Procedure is considered a matter of outstanding national economic importance, therefore, in accordance with Section 14 (2) b) ba) of Government Decree 322/2015 (X. 30.), the Contracting Authority (lawfully) omits the justification according to Section 14 (2) a) of Government Decree 322/2015 (X. 30.). The Reconstruction is carried out in a monument environment, as the property registered under cadastral number 33505 in the interior of Budapest is within the monument environment of the Herczel Sanatorium (monument), the Grünwald Sanatorium (monument), the ex-lege monument environment of the Reformed Church, and the ex-lege monument environment of the Ráth-György Villa. Although the latter indicate that the Reconstruction is carried out in a monument environment, the Property subject to the procurement is not a monument, therefore the provisions of Section 34 of Government Decree 322/2015 (X. 30.) are not applicable to the present Public Procurement Procedure. The design area is neither locally nor monumentally protected. "former museum, courtyard" property with an area of 17,050 m2, as well as the associated public areas and neighboring condominium properties are partial areas necessary for the realization of the project. Given that the present public procurement procedure does not fall within the scope of exceptions according to Section 2 (2) of Government Decree 283/2024 (IX. 30.), an National Architectural Council procedure (OÉT) is required for the necessary permit design documentation of the House of Public Corporations.
