Matters for Competitive Bidding: (1) Project Name: Kumamoto City Hall Public Wireless LAN Equipment Renewal Services Contract (2) Purpose and Overview: This service involves replacing the existing public wireless LAN (Wi-Fi) equipment to continue providing internet access to citizens and visitors. The authentication infrastructure for this public wireless LAN will be "Kumamoto Free Wi-Fi". (3) Performance Location: 1-1-1 Tedori-honcho, Chuo-ku, Kumamoto City (4) Performance Period: From the contract date until November 30, 2026. 2. Type of Bidding Procedure: This project will be conducted using a method where the qualifications required for participation in conditional public invitation for bids (hereinafter referred to as "Competitive Bidding Qualifications") are confirmed prior to bidding, and the successful bidder is determined based on the results of bids from those recognized as having Competitive Bidding Qualifications. This project will be conducted by mail-in bidding. 4. Competitive Bidding Qualifications: All of the following conditions must be met. (1) Must have submitted the "Application for Qualification Examination for Competitive Bidding for Kumamoto City Service Contracts, etc." and be registered in the list of qualified bidders stipulated in Article 5 of the "Guidelines for Qualifications of Bidders for Kumamoto City Service Contracts, etc." (Notice No. 731 of 2008), with registration in the "Equipment Maintenance" (Category 1) and "Other Equipment Maintenance" (Category 2) business types. (2) Must not fall under any of the provisions of Article 167-4, Paragraph 1 of the Local Autonomy Act (Cabinet Order No. 16 of 1947). (3) If an application for commencement of rehabilitation proceedings under Article 17 of the Corporate Rehabilitation Law (Law No. 154 of 2002) or an application for commencement of reconstruction proceedings under Article 21 of the Civil Reconstruction Law (Law No. 225 of 1999) has been filed, a decision to approve the rehabilitation plan or reconstruction plan must have been made, respectively. (4) Must not fall under the provisions of Article 3, Item 1 of the "Kumamoto City Measures for Exclusion of Violent Groups, etc. from Contracts" (Notice No. 105 of 2006). (5) Must not be within the period of suspension of bidding based on the "Kumamoto City Measures for Suspension of Bidding, etc. for Procurement of Goods and Services Contracts" (Notice No. 199 of 2009) and the "Kumamoto City Measures for Suspension of Bidding, etc. for Construction and Service Contracts" (Notice No. 108 of 1995). (6) Must not be in arrears of consumption tax, local consumption tax, or city taxes. (7) Must be engaged in the business of the contract subject to this competitive bidding as a profession. (8) Must not be a party deemed unsuitable as a contract partner due to violations or dishonest conduct in contracts with the City within the past three years. (9) Must comply with the "Kumamoto City Public Contract Ordinance" (Ordinance No. 54 of 2025), such as by submitting a letter of commitment. (10) Must have a head office or branch office, etc. within Kumamoto City. (11) Must be able to assign a person in charge of operations who meets all of the following conditions: (a) Possesses a First Class Digital Communications Engineer license, or a Comprehensive Communications Engineer license (formerly DD Class 1, or AI/DD Comprehensive). (b) Has a direct and continuous employment relationship of three months or more. (12) If applying as a business cooperative (a business cooperative as defined in Article 3 of the Small and Medium-sized Enterprise Cooperatives Act (Law No. 181 of 1949)), its members cannot apply as individual entities. Measures for Single Bidder: If there is only one bidder, a new announcement will be made to extend the deadline for submitting application documents. In this case, the competitive bidding qualifications or performance period may be changed as necessary. 10. Bidding, etc.: (1) Those confirmed to have competitive bidding qualifications by the notification in 5(3) shall submit their bids according to the following method. A. Submission Method: Submit by mail. Submissions by hand or electronic transmission (fax, email, etc.) will not be accepted. If a proxy submits by hand, a letter of proxy must be submitted separately. Therefore, bidders shall state the amount equivalent to 100/110 of their estimated contract amount in their bid, regardless of whether they are subject to or exempt from consumption tax. (3) The number of bidding rounds will be up to two (for the second and subsequent bids, refer to the handling of anticipated re-bids in 10(1)C). (4) Once a bid is submitted, it cannot be exchanged or withdrawn, regardless of whether the bid has been opened. (5) If a single bidder is found to have submitted multiple bids, the bids will be opened for confirmation, and all bids will be invalidated. (6) In addition to Article 7 of the "Kumamoto City Construction Bid Conditions" (Notice No. 107 of 1990), bids submitted with false information in the application documents will be invalidated, and if the successful bidder is found to have submitted an invalid bid, the award decision will be revoked. Furthermore, even if a bidder is confirmed to have competitive bidding qualifications, if they no longer meet the competitive bidding qualifications stipulated in 4 at the time of the award decision, they will be considered to have no competitive bidding qualifications. (7) Invalid bids will not be returned. 11. Bid Opening, etc.: Bids will be opened at the following date and time. Bids submitted by methods other than those specified in 10 (including those not received by the deadline) will be deemed invalid. 12. Method of Determining the Successful Bidder: (1) The bidder who submits the lowest valid bid within the limit of the estimated price will be the successful bidder. (2) If there are two or more bidders who submit the same lowest bid, the successful bidder will be determined by lottery. (3) A minimum reserve price will not be set. 13. Other Notes: (1) The language and currency used in the procedures shall be Japanese and Japanese currency, respectively. (2) Bid Bond: Exempted in accordance with Article 5 of the Kumamoto City Contract Management Regulations. (3) Contract Deposit: The successful bidder shall pay a contract deposit of 10% or more of the contract amount by the time of contract conclusion, as stipulated in Article 22 of the Kumamoto City Contract Management Regulations. However, the payment of the contract deposit may be substituted by providing interest-bearing government bonds or a guarantee from a financial institution. Furthermore, the contract deposit will be exempted in the following cases: A. When a performance guarantee insurance contract with the City as the insured is concluded with an insurance company, and the guarantee certificate is submitted by the time of contract conclusion. B. When a construction performance guarantee contract is concluded between the City and an insurance company entrusted by the successful bidder, and the guarantee certificate is submitted by the time of contract conclusion. C. When the bidder has faithfully performed contracts of similar type and scale with the national government or local public entities twice or more within the past two years, and submits proof of this (or a copy of the contract with documents certifying the proper completion of the contract by the ordering party).
