Use of the Government Electronic Procurement System This work will be conducted through bidding and bid opening/closing procedures using the "Procurement Portal/Electronic Procurement System" (https://www.p-portal.go.jp/pps-web-biz/) (hereinafter referred to as the "System"). However, submission of bids in "paper" format is also possible. 2. Matters concerning qualifications required for participation in competition (1) Not a person who falls under Article 70 of the Public Accounting Act (Imperial Ordinance No. 165 of 1947). (Minors, persons under guardianship or assistance, who have obtained the necessary consent for concluding the contract, fall under the special reasons in the same Article). (2) Not a person who falls under Article 71 of the Public Accounting Act. (3) Must be rated in "B" and "C" grades in the "Electrical Work" category in the FY2023-2024 Ministry of Finance Hokkaido Area Competitive Participation Qualifications. For "C" grade only, must be able to prove completion of LED conversion work of similar scale between April 1, 2020, and March 31, 2032. (4) Not a person who has filed for commencement of rehabilitation proceedings under the Corporate Rehabilitation Act (Act No. 154 of 2002) or for commencement of reorganization proceedings under the Civil Rehabilitation Act (Act No. 225 of 1999) (excluding those who have filed for commencement of rehabilitation proceedings under the Corporate Rehabilitation Act or commencement of reorganization proceedings under the Civil Rehabilitation Act and have undergone re-examination of the competitive participation qualifications under (3) above after the decision to commence proceedings). (5) Must be able to assign a supervising engineer or a chief engineer with a national qualification, and a site supervisor for the construction work, in accordance with the construction industry law permit category corresponding to the ordered work. (6) Not subject to bid suspension etc. from any ministry or agency (including those specially approved by the sub-disbursing officer for expenditure commitment). (7) Not a person who has violated a contract concluded with the contracting officer of this bureau, or who has refused to conclude a contract after becoming the successful bidder of a bid without justifiable reason, or who has engaged in fraudulent or dishonest conduct during bidding, and is deemed unsuitable as a contract counterparty. (8) Not a person whose financial condition or creditworthiness has not extremely deteriorated, and who can ensure proper performance of the contract. Bid bond: Exempted 10. Contract deposit: To be paid (Amount not less than 1/10 of the contract price). However, payment can be made by providing interest-bearing national bonds or by guarantee from a financial institution or guarantee company. Furthermore, if a performance guarantee bond for public works is provided or a performance guarantee insurance policy is concluded, the payment of the contract deposit will be exempted. 11. Invalid Bids (1) Bids submitted by persons who do not meet the competitive participation qualifications specified in item 3 above, or bids that violate the conditions of bidding specified in the tender explanation, shall be deemed invalid. (2) For bids submitted through the System, bids that violate the "Terms of Use for the Procurement Portal/Electronic Procurement System" shall be deemed invalid. (3) In principle, bids submitted with a breakdown sheet that is not submitted or is incomplete shall be deemed invalid. 12. Language and currency The language and currency used in bidding and contract procedures shall be Japanese and Japanese currency only. 13. Matters concerning consumption tax When determining the successful bid, the bid price shall be the amount written on the bid form plus 10% of that amount (if there is a fraction of less than 1 yen, it shall be rounded down). Therefore, bidders shall write the amount equivalent to 100/110 of their estimated price (including consumption tax) on the bid form, regardless of whether they are taxable or exempt from consumption tax. 14. Method of determining the successful bidder The successful bidder shall be the one who submits the lowest bid within the limit of the estimated price. However, if the bid falls under Article 84 of the Public Accounting Act and it is deemed that the contract may not be performed in accordance with its terms due to the bid price, or if it is deemed significantly inappropriate to conclude a contract with such bidder due to the risk of disrupting the order of fair trade, such bidder may not be selected as the successful bidder. 15. Construction performance evaluation For this work, if the contract price exceeds 5 million yen (including tax), it will be subject to construction performance evaluation as stipulated in Article 7 of the Act on Promotion of Quality Assurance in Public Works. The construction performance evaluation will be conducted upon completion inspection, and the evaluation results will be notified to the contractor via a construction performance evaluation notice. 16.
