Delivery of Bread

Introduction: Within the Municipality of The Hague, the restorative facilities department (DBV, SZW, DSB and DHW) purchases bread for the operation of various facilities, such as coffee corners and company restaurants. In 2020, this assignment was tendered via a European open procedure as a reserved assignment under Article 2.82 Aw. The submission of a Statement of Social Entrepreneurship was a suitability requirement. This suitability requirement was included because the municipality of The Hague values (local) social entrepreneurs. This tender resulted in one bidder, our current party, Lekker Brood. The agreement with Lekker Brood ended on October 1, 2024, but is extended until a new agreement is concluded. The goal is to realize a new agreement with Lekker Brood by September 1 for a maximum period of four years. The delivery of bread concerns the following locations: • DBV: Spui and Leyweg • SWZ: Fruitweg • DHW: Kerketuinenweg • DSB: Kerkhoflaan and Westduin • Additional locations may be added during the term of the agreement. Global description of the work: The work involves delivering bread to the aforementioned locations on order, meeting the requirements specified in the Program of Requirements. Justification for voluntary transparency procedure: The municipality proposes to use a negotiated procedure with prior publication (voluntary transparency). This choice is based on objective grounds, demonstrating that only one market provider is capable of carrying out the assignment. 1) The contracting authority/organization can demonstrate on objective grounds (e.g., based on an objective market research or market consultation) that there is only one market provider capable of performing the public contract. Thorough market research and consultation of the bakers' register show that only Lekker Brood can meet the suitability requirement, namely the ability to provide a Statement of Social Entrepreneurship. Furthermore, the results of a previous European open tender confirm this conclusion: only Lekker Brood submitted a bid at that time, underscoring the unique position of this party. 2) The lack of competition is not the result of an artificial limitation of the tender conditions (awarding to a single supplier). 3) The lack of competition is due to technical reasons. The conditions have been drawn up objectively and transparently, without preference for a specific supplier. 4) These technical reasons make it absolutely necessary to award the contract to this provider (necessity requirement). Lekker Brood is the only social bakery that can operate under the stipulated delivery conditions, meaning competition is absent in practice. 5) There is no reasonable alternative or substitute for the requested delivery or service. There is no reasonable alternative or substitute for the delivery of the requested supplies under the current conditions. 6) The contracting authority must demonstrate that it has done everything reasonably possible to avoid the application of this ground for exclusion. This is evident from the market research conducted and the previous open tender in which all market parties were given the opportunity to submit bids. Contract value: The estimated contract value is € 90,000 excluding VAT per year. The municipality intends to conclude an agreement for a maximum duration of four years. The maximum total contract value will therefore be € 360,000 excluding VAT.
