Sortimentele şi cantităţile de produse solicitate sunt împărţite în 2 (două) LOTURI, conform Anexei nr. 2 la prezentul caiet de sarcini. Contractele se adjudecă pentru CANTITATEA MINIMĂ DE PRODUSE (perioada de livrare mai - decembrie 2026). Cantitatea minimă reprezintă cantitatea ce face obiectul prezentei proceduri, cantitate necesară până la 31.12.2026 (pentru o perioadă estimată de 8 luni: mai – decembrie 2026), iar cantitatea maximă conţine şi eventualele suplimentări. Pentru acoperirea acestor suplimentări, există posibilitatea prelungirii contractelor prin acte adiţionale pentru perioada 01.01.2027 - 30.04.2027 cu condiţia existenţei alocărilor bugetare pentru această achiziţie şi menţinerii preţului unitar pentru fiecare produs, identic cu cel rezultat în urma atribuirii, în conformitate cu dispoziţiile art. 165 alin. (1) din H.G. nr. 395/2016. Autoritatea contractantă îşi rezervă dreptul de a diminua /suplimenta cantitatea contractată cu +/- 10% din valoarea contractată, prin act adiţional în conformitate cu dispoziţiile art. 221 alin. (1) lit. f) din Legea nr.98/2016 prin raportare la numarul de persoane asistate care vor beneficia de protecţie socială pe perioada de derulare a contractului. Autoritatea contractantă îşi rezervă dreptul de a nu achiziţiona întreaga cantitate contractată, cantitatea putând varia în funcție de urmatoarele situaţii: - externalizarea serviciului de preparare a hranei pe parcursul anului, reducerea cantităţilor se va face proporţional cu numărul de asistaţi care vor beneficia de acest serviciu. - reducerea numărului de asistaţi din centre. - alocarea insuficientă a fondurilor cu această destinaţie de către ordonatorul principal de credite. - donațiile în produse de acest gen primite de achizitor; - alte situaţii neprevăzute.
