Road marking works executed in thick layer - Hot-applied plastic products, necessary for national roads - motorways, expressways, international roads "E", main national roads, secondary national roads managed by C.N.A.I.R. S.A. - Lot 1 DRDP Bucharest

The object of the framework agreement is road marking works executed in thick layer - hot-applied plastic products, necessary for national roads - motorways, expressways, international roads "E", main national roads, secondary national roads managed by C.N.A.I.R. - S.A. Lot 1 - D.R.D.P. Bucharest, in accordance with the provisions of the Technical Specification and the legislation in force. In accordance with the contractual provisions, any modifications that may occur during the term of the framework agreement/subsequent contract refer to the following, without being limited to them: I. Parties to the Framework Agreement/Subsequent Contract: 1) from the perspective of changing the company name, the company form, which do not result in the creation of a new legal entity; 2) when the Contractor is replaced by a new Contractor, in the situation where the rights and obligations of the initial Contractor, resulting from the Framework Agreement, are taken over, as a result of a universal or universal succession in a reorganization process, including through merger, division, acquisition, or insolvency, by another economic operator that meets the initially established qualification and selection criteria, provided that this modification does not involve other substantial changes to the public procurement contract and is not made with the aim of circumventing the application of the award procedures provided for by Law no. 98/2016 on public procurement; II. Modification of the annexes to the Framework Agreement, which include the quantities of works to be executed: In objective cases, when framework agreements are not concluded at the lot/lots level, respectively for the Regional Road and Bridge Directorates, due to the non-finalization / cancellation of award procedures or the termination of the framework agreement, C.N.A.I.R. S.A. - Central may decide that the execution of marking works for the lot(s) without ongoing framework agreements be carried out under the framework agreement in progress at the level of the closest Regional Road and Bridge Directorate to the location where the road marking works are to be performed. The Contractor, at the request of the Contracting Authority, will travel and perform the necessary road marking works, within the limits of the allocated budgets and the quantities remaining to be executed under the framework agreements in progress from other DRDPs. Thus, an amount will be foreseen in the financial offer, representing 8% of the framework agreement value, for the transport of the marking execution crews to the location agreed upon with the Contracting Authority. For the reimbursement of transport, the number of km traveled, the number of vehicles, and the quantity of fuel consumed will be taken into account, and the calculations will be presented prior to the departure for the issuance of the approval by the DRDP that has the framework agreement in progress, and the amounts will be reimbursed by the regional directorate that has the framework agreement in progress. Confirmation of the executed marking works will be made by the DRDP within whose jurisdiction the road markings are executed. III. Technical modifications: in case of possible replacements of road marking products that do not comply with the specifications and quality requirements provided in the award documentation; IV. Payment methods and debt recovery: in case of possible changes in legislation, within the legal limits imposed by financial and tax legislation; V. Duration of the last subsequent contract: - extension without additional costs for the Contracting Authority and without reducing the warranty period for works already executed and accepted, in case the Contractor provides the Contracting Authority with justifications attesting to the necessity of extending the execution deadline(s) for the works.
