Road marking works executed in thin layer, necessary for national roads, motorways, expressways, international roads "E", main national roads, secondary national roads administered by C.N.A.I.R. S.A. Lot 1 – D.R.D.P. Bucharest

The subject of the framework agreement is road marking works executed in a thin layer, necessary for national roads, motorways, expressways, international roads "E", main national roads, secondary national roads administered by C.N.A.I.R. S.A. Lot 1 D.R.D.P. Bucharest, in accordance with the provisions of the Specification and the legislation in the field. In accordance with the contractual provisions, any modifications that may occur during the term of the framework agreement/subsequent contract refer to the following, without being limited to these: I. Parties to the Framework Agreement/Subsequent Contract: 1) from the perspective of changing the name, the form of the company, which do not lead to the creation of a new legal entity; 2) when the Contractor is replaced by a new Contractor, in the situation where the rights and obligations of the initial Contractor, resulting from the Framework Agreement, are taken over, as a result of a universal or universal succession in a reorganization process, including by merger, division, acquisition or insolvency, by another economic operator that meets the qualification and selection criteria initially established, provided that this modification does not involve other substantial modifications to the public procurement contract and is not made with the aim of circumventing the application of the award procedures provided by Public Procurement Law no. 98/2016; II. Technical modifications: in case of possible replacements of road marking products that do not comply with the specifications and quality requirements provided in the award documentation. III. Payment methods and debt recovery: in case of possible changes in legislation, within the legal limits imposed by the legislation in the financial and fiscal field; IV. Duration of the last subsequent contract: extension, without additional costs for the Buyer and without reducing the warranty period of the works already executed and accepted, if the Contractor provides the Buyer with justifications attesting to the necessity of extending the execution deadline(s) of the works. The duration of the last subsequent contract may exceed the validity period of the Framework Agreement. V. Subcontractors. Third-party supporters in case of possible changes of subcontractors during the term of the framework agreement/subsequent contract and/or in case of introduction of subcontractors and/or in case of their option to be paid directly by the Buyer, as well as in case the third-party supporters take over the contractual obligations, totally or partially, instead of the contractor.
