Prefabricated road markings and anti-skid road surfaces for national roads - motorways, expressways, international roads "E", main national roads, secondary national roads administered by C.N.A.I.R. - S.A.” Lot 1 – D.R.D.P. Timișoara

The object of the framework agreement is prefabricated road markings and anti-skid road surfaces for national roads - motorways, expressways, international roads "E", main national roads, secondary national roads administered by C.N.A.I.R. - S.A.” Lot 1 – D.R.D.P. Timișoara, in accordance with the provisions of the Specification and the legislation in force. In accordance with the contractual provisions, any changes that may occur during the term of the framework agreement/subsequent contract refer to the following, without being limited to these: I. Parties to the Framework Agreement/Subsequent Contract: 1) from the point of view of changing the name, the company form, which do not lead to the creation of a new legal entity; 2) when the Contractor is replaced by a new Contractor, in the situation where the rights and obligations of the initial Contractor, resulting from the Framework Agreement, are taken over, as a result of a universal or universal succession in a reorganization process, including by merger, division, acquisition or insolvency, by another economic operator that meets the qualification and selection criteria initially established, provided that this modification does not involve other substantial modifications of the public procurement contract and is not made with the aim of circumventing the award procedures provided by Public Procurement Law no. 98/2016; II. Modification of the annexes to the Framework Agreement, which include the quantities of works to be performed: In objective cases, when there are no framework agreements concluded at the lot level, respectively Regional Road and Bridge Directorates, due to the non-completion/cancellation of award procedures or the termination of the framework agreement, C.N.A.I.R. S.A. - Central may decide that the execution of marking works on the lot(s) without framework agreements in progress will be carried out based on the framework agreement in progress at the level of the Regional Road and Bridge Directorate closest to the location where the road marking works are to be performed. The Contractor, at the request of the Buyer, will travel and perform the necessary road marking works, within the limits of the allocated budgets and the quantities remaining to be executed under the framework agreements in progress from other DRDPs. Thus, an amount will be foreseen in the financial offer, representing 8% of the value of the framework agreement, for the transport of the marking execution crews to the location agreed with the Buyer. For the settlement of transport costs, the number of km traveled, the number of vehicles, the quantity of fuel consumed will be taken into account, and the calculations will be presented before the trip is made in order to issue the agreement by the DRDP that has the framework agreement in progress, and the amounts will be settled by the regional directorate that has the framework agreement in progress. Confirmation of the executed marking works will be made by the DRDP within whose jurisdiction the road markings are executed. III. Technical modifications: in case of possible replacements of road marking products that do not meet the specifications and quality requirements provided in the award documentation; IV. Payment methods and debt recovery: in case of possible changes in legislation, within the legal limits imposed by the legislation in the financial and fiscal field; V. Duration of the last subsequent contract: - extension, without additional costs for the Buyer and without reducing the warranty period of the works already executed and accepted, in case the Contractor provides the Buyer with justifications attesting to the necessity of extending the execution deadline(s) of the works.
