In case of a tie in the final score obtained between two or more proposals, the award will be given to the bidder with the highest score in the first criterion indicated below, and if the tie persists, it will continue with the second and third criterion until a tie-breaker is achieved, in the following order: 4th Compliance with formal requirements. If after following the order of criteria mentioned above, a tie still exists, the technical and evaluation committee will be responsible for defining the most suitable supplier or the award will be given to the bidder who first submitted the offer on the portal www.mercadopublico.cl, which will be verified with the "offer submission receipt". The bidder declares that, by the mere fact of participating in this tender, they expressly accept this integrity pact, undertaking to comply with each and every one of the stipulations contained therein, without prejudice to those indicated in the rest of the tender documents and other integral documents. Specifically, the bidder agrees to provide all information and documentation that is considered necessary and required according to these tender documents, expressly assuming the following commitments: a) The bidder undertakes to respect the fundamental rights of its workers, understood as those enshrined in Article 19, numbers 1, 4, 5, 6, 12, and 16 of the Political Constitution of the Republic, in accordance with Article 485 of the Labor Code. Likewise, the bidder undertakes to respect human rights, which means that it must avoid giving rise to or contributing to adverse effects on human rights through its activities, products, or services, and remedy such effects when they occur, in accordance with the UN Guiding Principles on Business and Human Rights. b) The bidder undertakes not to offer or grant, nor attempt to offer or grant, bribes, gifts, prizes, gratuities, or payments, of any type, nature, and/or amount, to any public official in relation to their offer, the public tender process, nor the execution of the contract(s) that may arise from it, nor to offer or grant them to third parties who could directly or indirectly influence the tender process, its decision-making, or the subsequent award and execution of the contract(s) derived from it. c) The bidder undertakes not to attempt or make agreements or carry out negotiations, acts, or conduct that aim to influence or affect in any way...
