Procurement of automotive diesel fuel

Procurement of automotive diesel fuel in accordance with the currently valid MSZ EN 590 standard within the framework of a framework purchase agreement. Total quantity: 86,330,310 liters / 36 months. Details are provided in the Price Table and Technical Description. The contracting authority undertakes to order 75% of the total quantity fixed in the framework agreement. The contracting authority has drawn attention to the provisions of Section 46 (3) of Government Decree 321/2015 (X. 30.). In its offer, the tenderer had to declare, among other things, with a legally binding signature that: • the quality of the product to be delivered, as well as the CFPP value, meets the requirements of the currently valid national standard MSZ EN 590; • it possesses, and undertakes to continuously possess during the term of the contract if it wins, a valid permit required for the distribution of excise goods, for automotive diesel fuel as an excise good; • the tenderer or its subcontractor performing the contract possesses, or in the event of the tenderer winning, will possess at the latest by the conclusion of the contract and continuously thereafter during the term of the contract: - at least 5 tank vehicles with a transport capacity of at least 30,000 liters of automotive diesel fuel, certified by the competent Hungarian authority (successor to MKEH) for printing register certificates, equipped with a flow meter system with heat compensation and an electronic sealing system; - a storage capacity of at least 3,000,000 liters of automotive diesel fuel; • it possesses, or in the event of the tenderer winning, will possess at the latest by the conclusion of the contract and continuously thereafter during the term of the contract, valid liability insurance with a per-incident limit of at least HUF 10,000,000 and an aggregate limit of at least HUF 100,000,000, and simultaneously with its offer, or at the latest by the conclusion of the contract, presents to the Contracting Authority the relevant policy or a certificate from the insurance company confirming its existence; • it will always provide a valid certificate for the delivered diesel fuel, which includes the parameters required by the relevant standard (MSZ EN 590 standard currently in force); • it undertakes warranty (Civil Code Section 248) for the product delivered by it, the duration of which is at least 14 calendar days from the date of acceptance, and accepts the conditions related to the warranty specified in further public procurement documents; • it acknowledges that - the time of communication of the order to the winning tenderer is the time of sending the order by the Contracting Authority to the email address or other ordering interface or application designated by the winning tenderer for receiving orders, - and the winning tenderer is obliged to ensure that the order is received at the email address or other ordering interface or application designated by it at the time of sending by the Contracting Authority; • it has familiarized itself with the personal data processing information on the Contracting Authority's website (https://www.bkv.hu/hu/content/adatvedelmi_tajekoztatas_besz) and has also informed its employees involved in the conclusion and performance of the contract, as well as other persons acting within its scope of interest and activity in relation thereto; • whether it qualifies as a data processor in connection with the services provided to the Contracting Authority. The tenderer also had to declare in its offer whether the prohibition on awarding the public procurement contract, as defined in Article 5k (1) of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of actions by Russia that destabilise the situation in Ukraine, applies to its offer.
