Predmet nabave je opskrba električnom energijom, specificiran i određen vrstom i predviđenom (okvirnom) količinom u Troškovniku i Prilogu I. – Mjerna mjesta, tarifni modeli i obračunski elementi, a koji se nalazi u prilogu. Gospodarski subjekti nude predmet nabave sukladno Općim uvjetima za korištenje mreže i opskrbu električnom energijom (NN 85/15 i 49/20, 104/20, 80/21 te eventualne izmjene) pridržavajući se Zakona o tržištu električne energije (NN 111/21) i ostalih propisa koji reguliraju ovo tržište. Obračun električne energije izvršit će Isporučitelj temeljem mjernih podataka koje će utvrditi Operator distribucijskog sustava mjernim uređajima na obračunskim mjernim mjestima Naručitelja, sukladno Općim uvjetima za korištenje mreže i opskrbu električnom energijom i Mrežnim pravilima distribucijskog sustava (NN 74/2018 i 52/2020 te eventualne izmjene). Obračunski element na temelju kojih se radi obračun opskrbe električnom energijom je: - preuzeta radna energija izražena u kWh. Kao obračunski element predviđa se i naknada za poticanje proizvodnje iz obnovljivih izvora energije (OIE) sukladno Odluci o naknadi za obnovljive izvore energije i visokoučinkovitu kogeneraciju (NN 87/17 i 57/20) i trošarina za poslovnu uporabu električne energije sukladno Zakonu o trošarinama (NN 106/2018) koje su uređene pozitivnim propisima Republike Hrvatske te druge moguće naknade, poreze ili dodatke sukladno važećim propisima, a koje je kupcu električne energije dužan obračunati opskrbljivač električnom energijom. U slučaju promjene propisa koji reguliraju iznos naknade za obnovljive izvore energije i visokoučinkovitu kogeneraciju ili trošarina za poslovnu/neposlovnu uporabu, na način da dođe do promjene iznosa navedene naknade odnosno trošarine, odabrani ponuditelj dužan je naplaćivati iznos naknade koja je sukladna iznosu koji na snazi u vrijeme izdavanja računa za isporučenu električnu energiju. Sukladno Uredbi o otklanjanju poremećaja na domaćem tržištu energije (NN 104/2022; NN 31/2023); Hrvatske ceste d.o.o. su pravna osoba s javnim ovlastima, te kao takve podliježu cijeni električne energije prema Članku 3. predmetne Uredbe.
