Tender Explanation Document
Regarding the tender for the specific procurement contract of the Japan Patent Office, based on the tender announcement dated September 8, FY2026, in addition to the provisions of relevant laws and regulations, the "Instructions for Tenders for Specific Procurement Contracts of the Ministry of Economy, Trade and Industry" (Document No. 5, hereinafter referred to as "Tender Instructions") and the "Terms of Use for Procurement Portal and Electronic Procurement System" (hereinafter referred to as "Terms of Use") when using the electronic procurement system, the following shall apply.
Furthermore, tender and bid opening procedures will generally be conducted using the electronic procurement system. In the event that the electronic procurement system cannot be used due to system failure or other reasons, the date and time may be changed.
1. Matters for Competitive Tender
(1) Subject and Quantity

As per the attached specifications (Document No. 2).
(3) Bidding Method
The bid amount shall be for the total sum of this matter. The calculation of the bid amount shall consider the following items:
A. When the bid amount includes expenses equivalent to personnel costs (labor costs)
Calculate using unit prices that consider minimum wage increases and salary revisions during the contract period (if calculating the revised amount during the contract period is difficult, calculations based on recent revision実績 are also acceptable).
B. When the bid amount includes expenses affected by increases in raw material costs and energy costs
Calculate using unit prices that consider the estimated increase in expenses due to soaring raw material and energy costs during the contract period (if calculating the increased amount during the contract period is difficult, calculations based on recent increase実績 are also acceptable).
Note: When determining the successful bid, the bid price plus an amount equivalent to the consumption tax rate applied to that amount (if there is a fraction of less than 1 yen, that fraction will be rounded down) will be the winning bid price. Therefore, bidders shall state in their bid the amount equivalent to 100/110 of the estimated amount, excluding costs subject to the reverse charge method, regardless of whether they are a taxable or tax-exempt business with respect to consumption tax and local consumption tax.
2. Eligibility for Participation in Competitive Tender
(1) The bidder must not fall under the provisions of Article 70 and Article 71 of the Budget, Settlement, and Accounting Order (Document No. 6, hereinafter referred to as "Order").
Minors, persons under guardianship, or persons under assistance who have obtained the necessary consent for contract conclusion fall under the special circumstances in Article 70 of the Order.
(2) The bidder must be rated "A", "B", or "C" in the "Provision of Services, etc." category of the FY2025, 2026, 2027 Ministry of Economy, Trade and Industry Competitive Bidding Qualifications (All Ministries Uniform Qualification).
(3) The bidder must not be subject to suspension of subsidies or designation suspension measures from the Ministry of Economy, Trade and Industry.
If subcontracting to a business subject to suspension of subsidies or designation suspension measures from the Ministry of Economy, Trade and Industry, the consent of the ordering party is required (excluding contracts less than 1 million yen).

(4) The bidder must not have had a contract with the Ministry of Economy, Trade and Industry terminated due to inadequate information management within the past three years.

If it is difficult to submit via the electronic procurement system due to unavoidable reasons, submit by one of the following methods to the contact person listed at the end of this announcement (11. (2)).
a. Submission in paper form
Submit the Tender Eligibility Requirements (Certificate of Conformity) (Document No. 3) and Form 4 "Reason Statement" (Document No. 10) in paper form (by hand or mail). However, if sending by mail, allow ample time, send by registered mail, and notify the contact person listed at the end of this announcement (11. (2)) that you have sent it by mail (if sending by mail, it must arrive by the submission deadline in A above).
b. Submission by email
Submit the Tender Eligibility Requirements (Certificate of Conformity) (Document No. 3) and Form 4 "Reason Statement" (Document No. 10) as email attachments. However, if the capacity exceeds 7MB, submit in parts.

*The envelope containing the bid form should only contain the bid form and bid amount breakdown, be sealed, and the bidder's name (or company name or trade name for corporations) and the subject matter should be written on the front of the envelope before submission. Do not include other documents such as the Certificate of Conformity.
C. Precautions
*For bids by an agent, the person submitting the bid form via the electronic procurement system must complete the delegation procedures specified in the system, and the person submitting the bid form in paper form must submit Form 5 "Power of Attorney" (Document No. 11).
*Submitted Tender Eligibility Requirements (Certificate of Conformity) and bid forms cannot be changed or canceled, and will not be returned.

If no bids are received within the limit of the estimated price after the bid opening, a second round of bidding will be held. If all bidders or their agents are present, the second round of bidding will be held immediately. Otherwise, it will be held at a separately determined date and time.
If a second round of bidding is held immediately, bidders who submitted their bid forms in paper form will participate in the second round of bidding at the above-mentioned bid opening location, and those who submitted their bid forms via the electronic procurement system will participate via the system.
If no bids are submitted by the deadline for the second round of bidding, the bidder will be deemed to have declined the second round of bidding.
*Bidders who submitted their bid forms via the electronic procurement system can check the status of the bid opening on the "Check Bid (Quotation, Winning Bid) Status" screen and the "Check Bid Opening Results" screen.
*If participating in the bid opening at the bid opening location, please contact the contact person listed at the end of this announcement (11. (2)) by email in advance.
C. Matters Concerning Persons Attending the Bid Opening
The bid opening shall be conducted with the attendance of the bidder or their agent. However, if the bidder or their agent is not present, the bid opening shall be conducted with the attendance of staff unrelated to the bid execution.
(7) Scope of Use of Electronic Procurement System
The electronic procurement system shall be used only for the purposes specified in (4), (5), and (6) above; use for other functions is not permitted.
4. Invalid Bids
Bids falling under Article 12 of the Tender Instructions shall be considered invalid.
5. Method of Determining the Successful Bidder and Notification Thereof
(1) Method of Determining the Successful Bidder
The successful bidder will be determined in accordance with Articles 15 to 17 of the Tender Instructions.
(2) Notification of Successful Bidder Determination
Upon determination of the successful bidder, notification will be sent in writing or by other means to the bidders who were not successful within 7 days from the day after the determination.

7. Quotation and Contract
(1) Submission of Quotation
The successful bidder shall submit a quotation immediately. Form 6 "Quotation" (Document No. 12) may be used as a reference for preparation.
(2) Contract
The successful bidder will enter into a contract based on the draft contract (Document No. 4). Therefore, please bid with an understanding of the contract terms.
8. Payment Terms
Payment will be made within 30 days of receipt of a valid payment request after the completion of the work.
