The present instrument aims at the emergency contracting of continuous fire prevention and fighting services and first aid, through the provision of civil firefighter posts, to be executed under a full-time labor dedication regime, in order to ensure, at all times, the protection of the facilities of the buildings managed by the Ministry of Management and Innovation in Public Services, as well as to guarantee the physical integrity of civil servants and the public.

It should be noted that the contracting object of this process will be carried out in the form of emergency contracting, based on article 75, item VIII, of Law No. 14.133/2021, given that the bidding procedure initiated through Process No. 10880.001071/2025-81 was unsuccessful, requiring adjustments to the Cost and Pricing Spreadsheet (PCFP) before the republication of the tender.

When adjustments were made and the tender was republished with a date set for 05/19/2026, it was again challenged, requiring a new intervention in the Terms of Reference with a date set for 05/27/2026.

Need for contracting: To preserve, at all times, the facilities of the tax buildings and the physical integrity of civil servants and the population that uses their premises, permanently or occasionally in the work environment, as well as the need to observe the determinations of State Decree No. 56.819/11 (Regulation for fire safety of buildings and risk areas in the State of São Paulo).

Justification: The provision of services aims to meet operational activities and tasks not covered by the “Job Classification Plan”, being those “ancillary, instrumental, and complementary material activities” to be executed indirectly, as provided for in Decree No. 9.507/2018 (art. 3, first paragraph), and the determination of this legal diploma is that the provision of these services be executed through third-party contracting.

Normative Instruction MPOG No. 05 of May 25, 2017 defines continuous services as: “those auxiliary services, necessary for the Administration to perform its duties, the interruption of which may compromise the continuity of its activities and whose contracting should extend for more than one fiscal year”.

The provision of services is classified in the list of service supply lines of the Federal Government's Unified Contractor Registration System Manual.
