Original language: DutchDe aanbestedende dienst heeft een onderhandelingsprocedure zonder aankondiging toegepast wegens dwingende spoed op grond van artikel 2.32 lid 1 sub c Aw 2012. Op basis van deze procedure heeft de gemeente een overeenkomst gesloten per 5 maart 2026 met Springplank040 B.V tot 1 juli 2026. De voornoemde looptijd van deze Overeenkomst kan onder gelijkblijvende voorwaarden door een eenzijdige verklaring van Opdrachtgever aan Contractant worden verlengd met telkens maximaal 3 maanden. Opdrachtgever spant zich ervoor in om de mededeling omtrent de verlenging uiterlijk 1 maand voor het einde van de looptijd te doen. De looptijd strekt zich derhalve uitsluitend uit over de periode die strikt noodzakelijk is om de continuïteit van de dienstverlening te waarborgen. De overeenkomst eindigt van rechtswege op de datum van inwerkingtreding van de nieuwe overeenkomst voor dezelfde dienstverlening (voortvloeiend uit de aanbesteding T170927 in Mercell). Gelet op de acute continuïteitsdreiging, de wettelijke opvangplicht en het stilvallen van de aanbesteding door een onvoorzien kort geding, is sprake van dwingende spoed die niet aan de gemeente te wijten is. Toepassing van de onderhandelingsprocedure zonder voorafgaande aankondiging is derhalve gerechtvaardigd, beperkt tot de strikt noodzakelijke overbruggingsperiode, uitsluitend om continuïteit te borgen totdat de reguliere aanbesteding kan worden hervat en gegund.
