Organization – preparation and execution of 13 two-day training courses, each 16 didactic hours for participants of the "Pomeranian Power of Knowledge" project

1. The subject of the order is the organization – preparation and execution of training courses for participants of the "Pomeranian Power of Knowledge" project, whereby: 1) The Contracting Authority has divided the order into parts. The order has been divided into 2 (two) parts. Part 1 includes: • Part 1: organization – preparation and execution of 13 two-day training courses, each 16 didactic hours for participants of the "Pomeranian Power of Knowledge" project, 2) The Contractor may submit an offer for any part/parts of the order. 2. The description of the subject of the order (including the description of the parts of the order) is specified in Annex No. 1a to the SWZ and in the draft contract, which is Annex No. 2a to the SWZ. 3. The training courses are carried out within the framework of project FEPM.05.17-IZ.00-0141/24 entitled "Pomeranian Power of Knowledge" within the framework of the European Funds for Pomerania 2021-2027 program, co-financed by the European Social Fund Plus. 4. The applicable law for this order (including for the contract concluded as a result of this procedure and for the legal effects of all documents in this order) is Polish law, taking into account the law of the European Union. 5. The Contracting Authority does not reserve the obligation for the Contractor to personally perform key parts of the order. The Contractor may entrust the performance of parts of the order to a Subcontractor. 6. In all provisions of the SWZ and its annexes, where the Contracting Authority refers to norms, approvals, technical specifications or reference systems, or where trademarks, parameters or sources of origin (names of manufacturers or devices) are indicated, in accordance with Art. 99 sec. 5 and Art. 101 sec. 4 of the Pzp Act, the Contracting Authority allows equivalent solutions. 7. In cases where the description of the subject of the order specifies materials or products of specific manufacturers, this should be treated solely as an indication of the desired standard and quality. In all such situations, the Contractor may offer equivalent materials and products with at least the same technical and quality parameters. Equivalence of a product means offering a product whose technical parameters of the materials used, performance, durability, and quality are not inferior to the quality of materials and products described in the SWZ. 8. A Contractor who refers to equivalent solutions is obliged to demonstrate that the solution offered by them meets the requirements specified by the Contracting Authority. In such a case, the Contractor shall attach to the offer a list of equivalent solutions along with their description or standards. 9. The Contracting Authority does not reserve the possibility of applying for the order only by Contractors referred to in Art. 94 of the Pzp Act. 10. Subcontracting: 1) The Contractor may entrust the performance of parts of the order to a Subcontractor (Subcontractors). 2) In connection with the execution of the order, the Contracting Authority does not reserve the obligation for personal performance of key tasks of the order. 3) The Contracting Authority requires that, in the event of entrusting parts of the order to Subcontractors, the Contractor shall indicate in the offer the parts of the order that they intend to entrust to Subcontractors and shall provide (if already known) the names of these Subcontractors. 4) Entrusting parts of the order to Subcontractors does not release the Contractor from responsibility for the proper execution of the contract. 11. Requirements regarding the employment by the Contractor or Subcontractor, based on an employment relationship, of persons performing the activities indicated by the Contracting Authority in the scope of executing this order: 1) Based on Art. 95 sec. 1 and 2 of the Act, it informs that it requires the Contractor or Subcontractor(s) to employ persons on the basis of an employment relationship who perform activities in the scope of executing the order, consisting in performing work in the manner specified in Art. 22 § 1 of the Act of June 26, 1974 – Labor Code. 2) Activities in the scope of executing the subject of the order, which the Contracting Authority indicates as requiring employment on the basis of an employment contract, are activities requiring supervision by the Contractor, with the exception of: a) activities that require...
