Package no. 1 - Expansion of the HIS system and supply of IT infrastructure

1. THE SUBJECT OF THE ORDER is the expansion of the HIS system and the supply of IT infrastructure. 2. The subject of the order has been described in detail in Annex No. 1 to the SWZ - Offer Form, Annex No. 2 to the SWZ - Description of the subject of the order and in Annex No. 5 to the SWZ – Draft Contractual Provisions, which specify the quantity of the subject of the order and the description of the subject of the order for individual parts of the order. 3. The subject of the order will be delivered at the Contractor's expense, risk, and transport. 4. The conditions for the execution of the Subject of the Order are also included in the Draft Contractual Provisions, which constitute Annex No. 5 to the SWZ. 5. The minimum guaranteed value of orders, to which the Contracting Authority will commit, is: 100% of the contract value. 6. The Contracting Authority does not foresee orders referred to in Art. 214 para. 1 points 7 and 8 of the Public Procurement Law (PZP). 7. The Contracting Authority does not intend to exercise the option right referred to in Art. 441 of the Pzp Law. 8. The Contracting Authority does not allow the submission of variant offers. 9. In the event that trademarks, patents or origin, source or specific process that characterizes products or services supplied by a specific contractor are used in the description of the subject of the order, it should be understood that such indication is always accompanied by the expression "or equivalent". 10. By "or equivalent", the Contracting Authority understands the offering of materials that guarantee the implementation of the task in accordance with the Contracting Authority's requirements and ensure the achievement of technical parameters no worse than those assumed in the SWZ. The use of equivalent solutions must not lead to a deterioration of the properties of the subject of the order compared to those provided for in the original documentation, nor to a change in price, nor to a violation of legal regulations. 11. Any product names or manufacturers included in the description of the subject of the order are used for illustrative purposes only, i.e., to approximate the requirements that could not be described using sufficiently precise and understandable terms. Any indicated product names and their manufacturers are not intended to violate the principle of fair competition and equal treatment of contractors. Wherever they are indicated, they should be read as being accompanied by the term "or equivalent". 12. The Contracting Authority allows the supply of equivalent products or equipment in relation to the description of the subject of the order, meaning that the offered subject of the order will have the same or higher technical, quality, functional and utility parameters as those indicated in the description of the subject of the order. 13. In the case of offers containing equivalent solutions, the Contracting Authority will verify them in terms of meeting the requirements of individual items of technical requirements contained in the Description of the Subject of the Order (OPZ). The OPZ defines the equivalence criteria through minimum technical, functional and quality parameters, and for selected items, it contains separate, detailed descriptions of equivalence constituting a closed catalog of requirements for equivalent solutions. The Contractor is obliged to prove the equivalence of the offered assortment in the offer, within the limits and in relation to the parameters specified by the Contracting Authority in the OPZ. The burden of proving equivalence is the Contractor's obligation. The Contracting Authority will not recognize equivalent solutions if they do not meet all the minimum technical, functional and quality parameters indicated for a given item in the OPZ. In the case of requirements described by means of standards, technical assessments or certificates, the Contracting Authority also allows equivalent standards, documents and certificates, confirming the fulfillment of requirements at least at the level specified in the order documentation. 14.
