The subject of this public procurement is: "Rehabilitation of a section of road PDV 3235 III-565, Shishmanzi-Orizovo /-Belozem-Bolyarino-Border of mun. (Rakovski-Brezovo)-Choba- /III-666/, Rakovski municipality", Sub-project: from km 0+000 to km 3+965 (north of the village of Bolyarino)" The construction object is of III category according to the Spatial Development Act (ZUT). A project has been prepared for the object and a building permit has entered into force. Funding source: No funding has been secured at the opening of this public procurement procedure, which is why the draft contract includes a clause for deferred execution, pursuant to Art. 114 of the Public Procurement Act (ZOP). In this case, either party may request the termination of the contract without notice after the expiry of a three-month period from its conclusion. It should be clear that, according to Art. 114, para. 2 of the ZOP, the execution of the contract begins after confirmation from the contracting authority of secured funding and the presentation of the performance guarantee by the contractor. When funding has not been secured after the expiry of a 10-month period from the conclusion of the contract, the contract is considered terminated. (Art. 114, para. 4 of the ZOP). Deadlines: - The term of the construction contract begins on the date of its signing and ends on the date of fulfillment of all obligations undertaken by the Parties under the Contract. - The deadline for the execution of construction and assembly works is offered by the contractor in calendar days. - Start: the date of proper signing of Protocol form 2/2a for the opening of the construction site and the determination of the construction line and level of the construction according to Annex No. 2/2a to Art. 7, para. 3, item 2 of Ordinance No. 3/2003 on the preparation of acts and protocols during construction; - End: the date of signing, by all participants in the investment process, of the Statement of Fact establishing the readiness for acceptance of the construction – Annex No. 15 to Art. 7, para. 3, item 15 of Ordinance No. 3/2003 on the preparation of acts and protocols during construction. The contracting authority determines the limits regarding the permissible deadline for the execution of construction and assembly works: 180 (one hundred and eighty) calendar days minimum execution period, respectively 240 (two hundred and forty) calendar days maximum execution period. When preparing their proposals, participants must strictly adhere to the specified minimum and maximum deadlines for the execution of construction and assembly works. When submitting the offer and formulating the execution deadline, the participant must necessarily propose an execution deadline in calendar days and as a whole number. A participant who proposes a deadline not in calendar days and/or not as a whole number will be disqualified! The contract enters into force upon its signing. The parties proceed to the commencement of construction works after receiving an order letter from the Contracting Authority to the Contractor for secured funding. Pursuant to Art. 111, para. 1 of the ZOP: "The contracting authority may require the selected contractor to provide guarantees that secure the performance of the contract and/or advance payments made". In this regard, the following guarantees are provided for the performance of the public procurement contract: - Performance guarantee in the amount of 3% (three percent) of the contract value excluding VAT; - Guarantee to secure advance payments in an amount equal to the advance payment (up to 20% of the contract value excluding VAT).
