Insurance for the transport of military equipment

The aim of this tender procedure is to conclude an insurance contract (hereinafter referred to as the "contract") with one participant in order to provide cargo insurance for the transport of military equipment within the CV90 project, carried out between the contracting authority and external suppliers. The subject of the public procurement is insurance relating primarily to transports of: – individual turrets, – complete military vehicles, – possibly other related components of military equipment. Transports will be carried out as the contracting authority's own transport or through contractual carriers. The insurance must cover transports generally carried out under FCA terms, and must also include damage incurred during loading and unloading of the transported property, including the use of specialized equipment. The insurance coverage begins at the moment the shipment is taken over for transport. Repeated transports are expected to be carried out in various logistical scenarios, particularly: – transports between suppliers and the contracting authority, – transports for testing (e.g., Bzenec), – transports for handover to the Army of the Czech Republic. The number of transports, their exact dates, and routes may change during the performance depending on the project development and coordination between the contracting authority and its contractual partners. The contracting authority reserves the right to arrange insurance for individual transports according to current needs and is not obliged to use the entire scope of performance. Due to the nature of the project and ongoing negotiations between the contracting authority and its partners, it is not possible to determine the exact transport schedule or their final scope at the time of awarding the public procurement. The insurance must be arranged to cover the variability of transports in terms of timing, scope of performance, and type of equipment transported. The contracting authority requires a maximum limit per transport of CZK 200,000,000. The required scope of insurance, i.e., insurance locations, scope and subject of insurance, sums insured, deductibles, and other insurance requirements, are detailed in the Technical Part of the Tender Documents and its attachments. The contracting authority restricts the publication of parts of the Tender Documents due to the protection of sensitive information related to the transport of military equipment. Attachments to the Technical Part of the Tender Documents are not freely available on the contracting authority's E-ZAK profile. A participant, or an interested party, can request the contracting authority to send the non-public part of the tender documentation via E-ZAK. The participant shall send a request for the provision of the non-public part of the Tender Documents, including an electronically signed Non-Disclosure Agreement (NDA), to the contracting authority via the E-ZAK electronic tool through the "Send Message" section. The contracting authority points out that the "Request for clarification of Tender Documents" function is exclusively for submitting questions regarding the tender conditions and is not intended for sending NDAs or requests for the non-public part of the Tender Documents. NDAs or requests for the non-public part of the Tender Documents delivered via the "Request for clarification of Tender Documents" function will be considered improperly submitted, and the contracting authority will not provide the non-public part of the Tender Documents based on them. In accordance with § 36 para. 8 and § 96 para. 2 of the Act, the contracting authority reserves the right to provide the non-public part of the Tender Documents only upon receipt of a proper request and an electronically signed NDA. The contracting authority will provide these attachments no later than 3 working days from the receipt of a proper request. The contracting authority strongly recommends all interested parties to request access to the non-public part of the Tender Documents before submitting a request to participate. The contracting authority points out that the non-public part of the Tender Documents contains information significant for the preparation of the offer in the second phase of the tender procedure and for the performance of the public procurement. If a participant does not request access to the non-public part of the Tender Documents, they bear full responsibility for the preparation of their request to participate and subsequently their offer without knowledge of this information. This fact will not be a reason for extending deadlines, changing tender conditions, or any other preferential treatment of the participant during the tender procedure. For the avoidance of doubt, the contracting authority states that the subject public procurement is not a contract for insurance brokerage services. The contracting authority does not permit variants of offers according to § 102 para. 1 of the Act based on the subject of the public procurement. A participant who submits an offer containing performance beyond the scope required in the Tender Documents will be excluded from further participation in the tender procedure.
