The Ordering Party, within the scope of the Order, foresees the possibility of applying the Option Right on the terms specified in the Operational Agreement. 7. The amount of funds made available to the Contractor under the Option Right may amount to up to 100% of the initial contribution from the Trust Fund made by the Ordering Party to the Special Fund. Loans granted by the Contractor from funds made available under the Option Right will be granted based on the principles contained in the Matrix, which is Annex No. 2 to the IPUO, and in the negotiation protocol applicable to the basic Order. 8. Pursuant to art. 95 sec. 1 of the Public Procurement Law, the Ordering Party obliges the Financial Intermediary to employ, on the basis of an employment relationship, persons who will perform activities within the scope of the Order concerning: 1) analysis of loan applications, 2) settlement and control of loans, 3) monitoring and debt collection of loan repayments, 4) preparation of reports on the Order implementation – if the performance of these activities involves performing work within the meaning of art. 22 § 1 of the Act of June 26, 1974 – Labour Code (Journal of Laws 2025, item 277, as amended).
