Expansion, maintenance and support for Microsoft software

The subject of the procurement is the continuation of maintenance of existing and procurement of new Microsoft products and services within the Enterprise Agreement (EA) model, in accordance with this Procurement Documentation and the Bill of Quantities, which indicate the name and quantity of the procurement items, as well as the conditions and requirements necessary for preparing an offer. The contracting authority will download the relevant Microsoft products via the Internet from the official manufacturer's website, or via the Microsoft website (VLSC – Volume Licensing Service Center), using the contracting authority's certified user account. For the purpose of delivering the procurement items, bidders must ensure an appropriate contract or contracts with the manufacturer, in order to ensure an optimal combination of rights and obligations in accordance with the Bill of Quantities and to protect the contracting authority from all claims by the manufacturer or third parties related to the products and services, but not related to the delivery of the procurement items or mentioned in the Procurement Documentation. The provisions of the contract with the manufacturer, as well as the accompanying manufacturer's documentation, will not apply in parts that contradict the positive legal regulations of the Republic of Croatia, the Procurement Documentation, and the concluded contract. The subject of the procurement consists of Microsoft products and services from the bidder that enable the continuity of the use of software and services with which Microsoft grants certain rights, or provides additional benefits and/or functionalities, in accordance with the technical specifications and other required conditions indicated in this Procurement Documentation. For the purpose of delivering the aforementioned products, the contracting authority will, through the selected bidder, activate a specific licensing agreement or agreements with the manufacturer. A detailed description of the subject of procurement is located in the chapter "Description of the subject of procurement", which is an annex to this Procurement Documentation – ANNEX 1, and the quantities are shown in the Bill of Quantities – ANNEX 2.
