Operator of selected heat sources

The award of a service concession is considered to be the conclusion of a paid contract, under which the contracting authority a) commissions the supplier to provide activities, with the supplier's consideration consisting of the right to derive benefits from the provision of services in the form of payments, and b) the contracting authority transfers the operational risk associated with deriving benefits from the provision of services to the supplier. The transfer of operational risk occurs if the supplier is not guaranteed a return on the costs incurred in providing the services that are the subject of the concession under normal market conditions. This may also include a partial transfer of operational risk, if the part of the operational risk transferred to the supplier involves actual exposure to market fluctuations such that any estimated losses for the supplier are not merely negligible. In this tender procedure, the contracting authority is selecting the operator for a total of 9 local heat sources (also referred to as 'Equipment') owned by the Municipal District of Brno-sever, with whom a concession contract will be concluded. The future operator (Concessionaire) will lease these heat sources from the contracting authority and will operate them, i.e., will ensure the supply of heat and domestic hot water (DHW) to the connection points connected to these Equipment, will carry out their reconstruction, and will perform repairs, maintenance, and inspections of the Equipment so that they are in perfect operational condition and meet all legal requirements and technical standards, and will also ensure the provision of emergency services and consulting activities. The Equipment is and will remain the property of the contracting authority. The subject of the performance of the public contract being awarded is therefore: 1) Lease of 9 Equipment by the contracting authority to the Concessionaire 2) Operation of 9 Equipment, production and distribution of thermal energy by the Concessionaire, 3) Reconstruction of 9 Equipment by the Concessionaire, including ensuring the processing of project documentation 4) Carrying out routine repairs, maintenance, and servicing, and inspections of 9 Equipment by the Concessionaire 5) Provision of emergency services for 9 heat sources by the Concessionaire 6) Carrying out repairs by the Concessionaire 7) Provision of consulting services by the Concessionaire to the contracting authority
