Operator of Selected Heat Sources

This tender concerns the award of a service concession for the operation of nine local heat sources owned by the Municipal District of Brno-sever. The contracting authority is seeking an operator who will enter into a concession agreement. Under this agreement, the contractor will be responsible for providing services related to these heat sources, with the remuneration consisting of the right to benefit from payments derived from the service provision. Crucially, the contracting authority will transfer the operational risk associated with these benefits to the contractor. This transfer of risk is defined as a situation where the contractor is not guaranteed a return on their invested costs under normal market conditions, even if the risk transfer is partial, provided it exposes the contractor to genuine market fluctuations and potential losses are not merely negligible.

The future operator, referred to as the Concessionaire, will lease the nine heat sources from the contracting authority. Their responsibilities will include operating the facilities to ensure the supply of heat and domestic hot water (DHW) to connected points of consumption. Furthermore, the Concessionaire will be required to undertake their reconstruction, including the preparation of project documentation. They will also be responsible for all repairs, maintenance, servicing, and inspections to ensure the facilities are in perfect operational condition and comply with all legal requirements and technical standards. The scope of work also includes providing emergency services and consultancy to the contracting authority. The heat sources will remain the property of the contracting authority throughout the concession period.
