Framework Agreement Archaeological Services

WSRL wishes to enter into a Framework Agreement with a maximum of five (5) companies capable of carrying out all research phases of archaeological research of land soils according to the protocols below: - Terms of Reference (protocol 4001); - Desk-based assessment (protocol 4002); - Inventarising field research (protocol 4003); - Excavation (protocol 4004). CPV 71351914‑3 – Archaeological services (Services) CPV 45112450‑4 – Excavation work (Works) Excavation (protocol 4004): This work falls within the scope of the Procurement Act and Directive 2014/24/EU under Works, due to its physical and intrusive nature: - Systematic excavation and removal of soil layers with archaeological remains. - Leads to an irreversible physical intervention in the soil. In procurement law terms, this is considered a Work, as it involves carrying out earthworks with a tangible result (the “creation” of an excavation result). In practice, excavation is sometimes tendered as a service, but legally it is most accurate to classify it as a Work, especially for large-scale or infrastructure-related excavations. If, in a subsequent order, only Excavation (protocol 4004) applies, then this work will be carried out in accordance with the UAV or UAV-Gc. This will be stated in the subsequent request for quotation. Outside the scope of the framework agreement - Protocol 4006 (specialist research) and 4010 (depot management) are outside the scope of this tender. - Archaeological research of water bodies is not part of this Framework Agreement. For archaeological research of water bodies, the lotting system is used (for explanation see section 1.4.1 of the guide). WSRL intends to conclude a framework agreement with the five (5) Bidders who meet the specified formal requirements, exclusion grounds, and suitability requirements and who, based on the award criterion of lowest price, are among the five best bids. WSRL requests subsequent quotations within the Framework Agreement. How a subsequent order is established and the way subsequent orders/agreements are awarded is described in section 4.10 of the guide. The Framework Agreement has a term of two (2) years. Optionally, it is possible to unilaterally extend the Framework Agreement twice (2) for one (1) year under the same conditions. The volume of this Framework Agreement during the four-year term cannot be estimated by WSRL in advance. Therefore, no guarantee can be given regarding the number or nature of the assignments to be awarded. Based on historical data (section 1.3.3 of the guide) and budgets, the estimated total volume has been set at €1,000,000 excluding VAT. Should the total value of the assignments exceed the estimated value, WSRL has the option to continue to request assignments within the framework agreements until the period of the Framework Agreements (at the latest 4 years) has expired. No rights can be derived from this estimate.
