Framework agreement for supply and services in the field of ultrasound devices - Lot 2

The present project represents a new negotiation round within the framework of the already ongoing procurement procedure Framework agreement for the supply of ultrasound devices - 2025035. The procedure was originally announced in EU notice OJ S 176/2025 15/09/2025 in the Supplement to the Official Journal of the European Union. This new negotiation round is explicitly not an independent, newly initiated procurement procedure within the meaning of the Procurement Ordinance (VgV). In particular, there is no new procurement procedure within the meaning of §§ 14 ff. VgV. Rather, this negotiation round is an integral part and direct continuation of the ongoing procedure 2025035, which was initiated with the aforementioned notice. The legal basis for procurement, the scope of application, and the procedural framework remain unchanged compared to the original procedure. The execution of this negotiation round is technically and organizationally carried out in a newly created project space. This approach is solely due to a technical necessity: the new negotiation round cannot be mapped in the existing system within the original project space of procedure 2025035; another technical representation is not possible. The creation of a new project space therefore serves solely the system-based management and structuring of this negotiation round and has no legal significance for procurement. In particular, it does not constitute a new start of the procedure and does not trigger any new procurement obligations (e.g., new notice, new suitability assessment, or new start of deadlines). All decisions made within procedure 2025035, documented procedural steps, as well as the determined suitability of the remaining bidders, remain fully valid and will be continued in this negotiation round. The negotiation round seamlessly picks up where the previous procedural status left off.
