Framework agreement for the purchase of cardio equipment

Team Danmark's organization consists of a CEO, a sports director, and approximately 50 employees working in seven sports-related areas: Sports cooperation, career and talent development, sports medicine, sports physiology, analysis, nutrition, and psychology. Team Danmark's vision is to create the best possible conditions and framework for Danish elite sports and for individual athletes. Developing world-class elite sports thus means for Team Danmark ensuring a coherent thread through the athlete's journey – from the club where it all starts, all the way to the top of the medal podium and beyond to life after their sports career. It is about both people and medals. To be able to realize this vision, it is crucial that Team Danmark's athletes and coaches have access to high-quality training equipment that supports optimal training, recovery, and performance at the highest international level. Team Danmark thus wishes with this tender to purchase training equipment that will contribute to ensuring Danish elite athletes the best possible physical conditions and opportunities to develop and realize their full potential within a total budget of DKK 8 million excluding VAT. Against this background, Team Danmark is tendering the following three non-exclusive sub-contracts, all of which are tendered as framework agreements for a 4-year period, but where the supplier awarded the individual sub-contract is guaranteed a one-off purchase made by Team Danmark immediately after the conclusion of the relevant sub-contract, and where the training equipment covered by the one-off purchase must be delivered to Team Danmark no later than April 2027: (i) Sub-contract A, concerning a one-off purchase of cardio equipment as well as ongoing purchases of cardio equipment with a maximum amount of DKK 2.5 million excluding VAT in total (ii) Sub-contract B, concerning a one-off purchase of training machines as well as ongoing purchases of training machines with a maximum amount of DKK 2.5 million excluding VAT in total (iii) Sub-contract C, concerning a one-off purchase of barbells and free weights as well as ongoing purchases of barbells and free weights with a maximum amount of DKK 3 million excluding VAT in total. The one-off purchase that Team Danmark commits to making immediately after the conclusion of the relevant sub-contract is further defined in the tender list. In addition to the one-off purchase, Team Danmark has no obligation to purchase under sub-contract A, sub-contract B, or sub-contract C. The expected purchasing need over the next four years is included in the tender list for evaluation purposes. This expected purchasing need is only indicative and based on Team Danmark's estimate of the expected purchase and is therefore not binding for Team Danmark. This means that the supplier(s) awarded sub-contract A and/or sub-contract B or sub-contract C cannot make claims against Team Danmark if Team Danmark's purchasing need turns out to be less than what is stated in the tender list. Likewise, the supplier for each sub-contract must be able to deliver larger quantities than what is stated in the estimated purchase, as all three sub-contracts include a provision that Team Danmark is entitled to increase the framework of the sub-contracts by 50% up to six months before the end of the sub-contracts' purchasing period. The division into three sub-contracts is justified by the fact that the market for cardio equipment (sub-contract A), training machines (sub-contract B), and barbells and free weights (sub-contract C) respectively, largely consists of different and partly specialized suppliers, which is why a division gives more companies, including smaller and more specialized suppliers, the opportunity to submit offers for the sub-contract(s) that match their business area. The division thus supports competition for the individual sub-contract and increases the likelihood that Team Danmark receives competitive offers for all three product categories.
