Description

Die Kaufmännische Krankenkasse - KKH (im Folgenden KKH) verfolgt das Ziel, mit allen geeigneten pharmazeutischen Unternehmen Rabattverträge nach § 130a Absatz 8 SGB V über den unter BT-21-Lot gennanten Wirkstoff (ATC) und ggf. einschränkend auf bestimmte Darreichungsformen im Rahmen eines sogenannten "Open-House-Verfahrens" abzuschließen. Unter Vorgabe einheitlicher Vertragskonditionen sowie eines einheitlichen Zugangsverfahrens wird allen geeigneten und interessierten pharmazeutischen Unternehmen oder Gemeinschaften pharmazeutischer Unternehmen der Abschluss bzw. Beitritt zu einem Rabattvertrag nach § 130a Abs. 8 SGB V zu dem o.g. Wirkstoff angeboten. Interessierte pharmazeutische Unternehmen können dazu bei der genannten Kontaktadresse die Teilnahmeunterlagen sowie den Vertrag anfordern. Voraussetzung für den Abschluss eines Vertrages ist, dass das interessierte pharmazeutische Unternehmen die angeforderten Teilnahmeunterlagen vollständig ausgefüllt und unterzeichnet vorlegt. Mit jedem pharmazeutischen Unternehmen, das die Teilnahmevoraussetzungen erfüllt, wird ein Vertrag abgeschlossen. Eine Exklusivität ist nicht gegeben. Der Beitritt bzw. der Vertragsabschluss kann jederzeit und zu den gleichen Bedingungen erfolgen. Individuelle Vertragsverhandlungen werden nicht durchgeführt. Sollte die KKH während der Vertragslaufzeit für die Wirkstoffe eine Ausschreibung von Exklusivverträgen im Form des Offenen Verfahrens durchführen, werden die im Rahmen dieser Veröffentlichung geschlossenen Verträge entsprechend den vertraglichen Regelungen beendet.
