For responsible execution (including handover file and guarantees), connection to the original design and engineering documentation and interpretation/validation of the as-built situation is a prerequisite. The copyright applies not only to the design documents but also to the design itself, where the moral rights play an important role. Although reverse engineering is theoretically possible, it is very complex in practice and does not guarantee a correct interpretation of the design. This copyright protection is an additional circumstance, alongside the technical complexity, why no reasonable alternative or substitute is available within the established scope (renovation, reuse, preservation of identity). Nijha is the only party that possesses the necessary technical information and expertise to carry out the assignment. If a market party wishes to take legal action against this announcement of voluntary transparency award decision by the municipality, the tenderer must initiate summary proceedings at the District Court in Amsterdam by serving a writ of summons within twenty calendar days after the day the announcement was sent. A copy of the writ of summons must be sent to inkoopfysiek@amsterdam.nl as soon as possible. If summary proceedings are not initiated within twenty calendar days after the day the announcement was sent, the municipality may proceed to conclude the agreement.
