The subject of the framework agreement is the purchase of toilet articles and their delivery to the branches of the Romanian Automobile Register-R.A., with procurement funded by own funds. - Given that the tender documentation contains a minimum set of specific information regarding estimates of minimum and maximum quantities that may be requested during the entire framework agreement, as well as estimates of minimum and maximum quantities that may be subject to a single subsequent contract among those to be awarded during the framework agreement, we emphasize that these minimum and maximum quantities that the contracting authority initially establishes in the tender documentation and subsequently in the framework agreement represent estimates of quantities that may be requested during the entire framework agreement and not the exact quantities that will be purchased, the latter being potentially smaller, equal to, or larger than the estimated ones, depending on the actual needs of the contracting authority. - The Promising Buyer reserves the right/option to supplement the estimated quantity at the level of the tender documentation by up to a maximum of 10% of the maximum quantity for the framework agreement/subsequent contract, for each product category. - The price of products to be additionally purchased under the revision clause will be that from the financial proposal forming the basis of the framework agreement (adjusted as necessary according to the adjustment formula), and the period during which this option can be used by the Promising Buyer is for the entire validity period of the framework agreement/subsequent contract. - Given the revision clause above, the estimated value of the procedure, from the level of section II.1.5 of the data sheet, will be expressed as an interval, the minimum value of the interval representing the estimated value of this procedure based on which the offers will be evaluated, and the maximum value represents the estimated value including the value of possible supplements. - Thus, the maximum value of the interval found in section II.1.5 of the data sheet, respectively the value resulting from possible supplements, is 2,404,899.2 lei excluding VAT for lot 1, and 207,165.55 lei excluding VAT for lot 2. - The modification of the framework agreement/subsequent contract based on this revision clause is regulated by art. 221 para. (1) letter a) of Law no. 98/2016 and falls within the scope of non-substantial modification, having all the elements provided by art. 2 para. (1)-(2) of ANAP Instruction no. 1/2021.
