"Expansion of district road No. 3040P on the Niezgoda – Sierakowo section and construction of a new road section Sierakowo – DK92 – A2 Motorway, in a design and build formula."

1. The scope of the subject of the order includes the design and, based on the executed design documentation, the execution of: 1) expansion of district road No. 3040P on the Niezgoda – Sierakowo section and 2) construction of a new road section Sierakowo – DK92 – Motorway, for the task carried out in the design and build formula entitled "Expansion of district road No. 3040P on the Niezgoda – Sierakowo section and construction of a new road section Sierakowo-DK92-A2 Motorway". 2. The subject of the order is the execution of the investment task entitled "Expansion of district road No. 3040P on the Niezgoda – Sierakowo section and construction of a new road section Sierakowo – DK92 – A2 Motorway", in accordance with Annex No. 1, i.e. the Functional-Utility Program (PFU). 3. The subject order includes, among others: 1) development of design documentation, including obtaining necessary decisions, opinions, approvals, and preparation of materials for submitting an application to obtain a decision on road investment permit (ZRID) on behalf of the Ordering Party, as well as obtaining the ZRID decision and other administrative decisions necessary to carry out the task, 2) execution of construction works for the subject task based on the design documentation prepared by the Contractor (in accordance with the Regulation of the Minister of Development of September 11, 2020, on the detailed scope and form of design documentation - Journal of Laws 2022, item 1697, as amended) and Detailed Technical Specifications (developed by the Contractor and executed in accordance with the Regulation of the Minister of Development and Technology of December 20, 2021, on the detailed scope and form of design documentation, technical specifications for the execution and acceptance of construction works and the functional-utility program, i.e. Journal of Laws 2021, item 2454) and relevant legal provisions. 4. The section of the pedestrian-bicycle path from approx. km 9+400 to approx. km 11+645 (main kilometerage), specified in Annex No. 1 – Functional-Utility Program (PFU), is excluded from the execution of the subject order. 5. Detailed conditions, scope, and principles of order execution are specified in Annex No. 1 – PFU and Annex No. 9 – Draft Contract Provisions, as well as in the relevant provisions of the Construction Law Act. 6. The Ordering Party anticipates the possibility of granting orders referred to in Art. 214 sec. 1 point 7 of the Pzp, consisting in the construction of a pedestrian-bicycle path with a maximum value of PLN 4,500,000 gross (in words: four million five hundred thousand PLN gross 00/100). 7. Pursuant to Art. 257 of the Pzp Act, the Ordering Party reserves the right to annul this proceeding if the public funds intended to finance all or part of the order have not been granted to him. 8. The Ordering Party reserves the obligation for the Contractor to personally perform the following key tasks: bridge works in terms of reinforced concrete works and road works in terms of sub-base and surface execution. 9. The Ordering Party informs that a mandatory site visit is planned. Date of site visit: 21.11.2025 at 10:00 AM in Niezgoda (investment start location). The Ordering Party informs that pursuant to Art. 226 sec. 1 point 18 of the Pzp, offers from Contractors who do not attend the mandatory site visit will be rejected.
