Description

The Sports Councils commissioned and published the Transgender Inclusion in Domestic Sport Guidance in September 2021. The Guidance is supported by several background documents, including the Transgender International Research Literature Review 2021. In April 2025, the Supreme Court Ruling (For Women Scotland Ltd V The Scottish Ministers) ruled that, under the 2010 Equality Act, the protected characteristic of ‘sex’ means a person’s biological sex. The updated Equalities and Human Rights Commission Statutory Code of Practice for services, public functions and associations became legally binding on 5 August 2026 and provides guidance as to how the Equality Act 2010 should be applied. Following advice from legal counsel, and a literature review on the topic, the Sports Councils CEOs agreed that a full review is required. Sport England (on behalf of the Sports Councils) now seeks to appoint a supplier to review and revise the Transgender Inclusion in Domestic Sports Guidance from a scientific, medical and policy standpoint, to guide National Governing Bodies of sport (NGBs) and others in the sport sector to create transgender inclusion policies INSTRUCTIONS FOR INTERESTED PARTIES: To receive instructions on how to access the Procurement opportunity which is due to go live on 8th October 2026, please email Procurement@sportengland.org on or before 7th October 2026.
