Article 12. If the purchasing evaluation committee deems it necessary, it may request clarifications from the proponents through the Portal regarding aspects of their offer that are not sufficiently clear. In such cases, the clarifications requested and the responses provided by the respective bidder will become an integral part of the contract documents, should it be awarded.
Neither the request for clarifications nor the bidder's responses may refer to points that alter essential elements of the proposal, nor violate the principle of equality among bidders. If this occurs, the offer will be declared inadmissible.
Responses must be submitted no later than 2 business days following the request, through the Portal.
Article 21. In accordance with Article 58, paragraph 5, of the Public Procurement Law Regulations, bidders may submit inquiries regarding the award. The following mechanism is established for resolving inquiries:
1°. Within the mandatory period of 3 business days, counted from the notification of the award resolution, interested parties may submit inquiries regarding the award by email to adquisiciones@gendarmeria.cl, indicating their full name, email address, and the name and ID of the proposal.
2°. Responses will be sent within 5 business days following the inquiry, via email to the interested party who submitted the inquiry.
3°. Along with the sending of said email and within the same period, the questions and answers will be published in the tender ID.
This same procedure will apply in case the inquiry concerns the declaration of inadmissibility of the offer, or if the tender process is declared void.
In case of a tie in the final evaluation score, the offer that obtained the highest score in the 'Price' evaluation criterion will be prioritized first. If the tie persists, the evaluation will continue with the remaining criteria, according to the importance assigned to their weighting. In the event that the tie occurs regarding the criteria of better employment and remuneration conditions, implementation of environmental sustainability policies and/or programs, and integrity program, preference will be given successively in the indicated order.
