In case of a tie, JUNAEB will award the offer that has been best evaluated according to the following order of priority of criteria:
a) Technical evaluation criterion
b) Economic evaluation criterion
c) Administrative evaluation criterion.

The supplier must strictly comply with the labor, social security, and compensation obligations for all workers who have provided personal services for them and their subcontractors in the execution of the contract.
All personnel that the supplier employs in the execution of the contract will be provided by them, under their exclusive subordination and dependency, without any contractual relationship existing between them and JUNAEB. Therefore, the supplier hereby undertakes to assume, in their capacity as employer, full responsibility for the complete and timely fulfillment of all and each of the obligations that, in accordance with current labor, social security, tax, health, and safety legislation, emanate.
The supplier must pay special attention to the provisions established in Law No. 21.643, which modifies the Labor Code and other legal bodies regarding the prevention, investigation, and sanction of workplace harassment, sexual harassment, or workplace violence; as well as Decree No. 21 of 2024 from the Ministry of Labor and Social Welfare, which approves the regulations with guidelines for investigation procedures on these matters.
Likewise, they must comply, as applicable, with exempt resolution No. DN-2430/2024 dated August 16, 2024, which approves the protocol for the prevention of sexual harassment, workplace harassment, and workplace violence, issued by the National Board of School Aid and Scholarships (JUNAEB); and exempt resolution No. DN-2440/2024 dated August 19, 2024, which approves the procedure for the reporting, investigation, and sanction of sexual harassment, workplace harassment, and workplace violence, superseding exempt resolution No. 632 of the year 2020. Furthermore, they must comply with any future administrative act that modifies or replaces these provisions.
