In case of ties between the best-evaluated bidders, the following tie-breaking rules will be applied successively: a) First decimal in the final score. b) Higher score in the technical offer. c) Higher score in the economic offer. d) If the tie persists, the bidder who first submitted their offer on the portal will be preferred, according to the information on the respective offer submission receipts. Inquiries about the award must be made within the fatal period of 5 business days, counted from the publication on the Information System www.mercadopublico.cl. The Municipal Corporation of Lo Prado will have the same period indicated above to respond, counted from the expiration of the deadline for submitting these inquiries. This period will not affect the validity of the contract. a) It will be the responsibility of the bidder to ensure they remain registered in the Supplier Registry. b) The bidder will release the contracting entity from all responsibility in case of actions brought by third parties due to infringements of intellectual, industrial, patent, trademark, and design rights, as indicated in Law No. 17.336 on Intellectual Property. c) Ensure the quality and timeliness of the delivery of reports and other products required for the services commissioned, under penalty of measures that the contracting entity may apply in case of non-compliance with what was requested. d) Meetings not included in these tender documents that are requested during the execution of the contract must be requested by the person duly authorized by the bidder, which must be reliably documented. e) Respond and manage, as appropriate, all requirements and/or inquiries arising from the contracting entity within a maximum period of 2 business days, counted from the notification thereof. Deliver the documentation requested by the contracting entity in a timely manner, i.e., within the deadlines determined by the contracting entity for their delivery. f) Provide the services that were awarded within the committed deadlines according to their awarded offer and complying with the corresponding technical specifications and requirements established in these tender documents. g) The supplier will be exclusively responsible, and without this enumeration being exhaustive, for the timely payment of salaries, fees, indemnities, severance pay, bonuses, travel expenses, benefits, and in general, of all...
