Upon signing the contract, or accepting the purchase order, if applicable, the awarded bidder must present a certificate accrediting compliance with labor obligations and social security contributions by the awarded company for its workers. This certificate must be issued by the Labor Inspectorate or by authorized companies to issue such certificates. In the event that the certificate shows debts or outstanding balances of remuneration or social security contributions, the first payment statements resulting from the tendered contract must be allocated to the payment of said obligations, and the awarded bidder must prove that all obligations have been settled within a maximum period of six months, in accordance with Article 4, second paragraph, of Law No. 19.886. Failure to comply with this obligation, as well as the failure to present said certificate, will authorize the Service to terminate the contract and may call for a new tender. Once the electronic opening of offers has been carried out, the tendering entity may request bidders to correct formal errors or omissions, provided that the rectifications of such defects or omissions do not grant those bidders a privileged position with respect to other competitors, i.e., as long as the principles of strict adherence to the bases and equality of bidders are not affected, and the rest of the bidders are informed of such request if applicable through the Information System. The Service may also allow, in accordance with Article 56 of the Regulations, the submission of certifications or administrative background information that bidders have omitted to submit at the time of making the offer, provided that such certifications or background information have been produced or obtained prior to the deadline for submitting offers or refer to non-mutable situations between the deadline for submitting offers and the evaluation period.
